Motion carried, 6 ayes - 1 nay, with Council Member Jason Rogers casting the dissenting vote. 12. Deliberate and act on the Final Plat of Lot 9, Block A, Pecan Place Phase 11 Addition. A Motion to approve the Final Plat was made by Council Meinber Rhonda Rogers and seconded by Council Member Pickle. Motion carried, 6 ayes - 1 nay, with Council Member Jason Rogers casting the dissenting vote. 13. Receive and deliberate on report from the City Clerk regarding the Initiative Petition and Supplemental Petition filed by petitioners prohibiting privatization of the collection, handling, and disposition of residential garbage, trash, and rubbish. City Clerk Janice Ellis reported that a supplemental petition was filed January 28, 2011, and that it contained the signature of an additional 11 l qualified voters. Ms. Ellis said in order to bring this issue to a vote, that 370 qualified voters were required to sign the petition. She also said the petition and supplemental petition contained a total of 431 qualified voters and she had issued a certificate of sufficiency. 14. Deliberate and act on RESOLUTION NO. 2011-007: A RESOLUTION OF THE CITY GOUNCIL OF THE CITY OF PARIS, TEXAS, RECEIVING AND ACKNOWLEDGING THE CERTIFICATION BY THE CITY CLERK OF AN INITIATIVE PETITION CALLING FOR THE ADOPTION BY CITY COUNCIL OF AN ORDINANCE PROHIBITING THE PRIVATIZATION OF THE COLLECTION AND DISPOSITION OF RESIDENTIAL TRASH IN THE CITY OF PARIS AND PROVIDING A METHOD OF FIXING CHARGES FOR SUCH SERVICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. A Motion to approve this item was made by Council Meinber Rhonda Rogers and seconded by Council Member Wright. Motion carried, 7 ayes - 0 nays. 15. Aublic hearing, public reading, deliberate and possibly act on an ORDINANCE BY AND FOR THIS C1TY OF PARIS, LAMAR COUNTY TEXAS, PROHIBITING PRIVATIZATION OF THE COLLECTION AND DISPOSITION OF RESIDENTIAL GARBAGE, TRASH, AND RUBBISH AND PROVIDING FOR THE METHOD OF FIXING CHARGES FOR SUCH SERVICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT OF RESIDENTIAL GARBAGE, TRASH, AND RUBBISH COLLECTION; PROVIDING A PENALTY GLAUSE; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES OR PARTS OF ORDiNANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. ~
