<br /> <br /> <br /> CITY COUNCIL AGENDA ITEM BRIEFING SHEET <br /> <br /> Submittal Date: Originating Department: Presented By: Agenda Item No.: <br /> 4/01/11 Historic Preservation Shawn Napier; Director of <br /> Council Date: Commission/Nomination Engineering, Planning and 16. <br /> 04/25/11 of Historical Signs Development <br /> RECOMMENDED MOTION: <br /> Move to approve a nomination of certain Historic Signs located in the Downtown Historic District. <br /> <br /> POLICY ISSUE(S): <br /> Council objective; nomination of certain Historic Signs <br /> BACKGROUND: <br /> At its March 28, 2011, meeting, the Historic Preservation Commission requested the nomination of <br /> seven signs located in the Downtown Historic District to protect them from forced removal. The sign <br /> ordinance, Ordinance 2008-021, Section 28-9(d) Historically significant signs states; The historic <br /> preservation commission, the committee charged with protecting historical districts, may nominate signs <br /> located in such districts as historically significant signs. The city council shall hold a public hearing <br /> and make final determination as to the historical significance of such nominated sign, and if such sign is <br /> found to be historically significant then the prohibition herein shall not regulate such sign. However, <br /> such sign may only be maintained and shall not be enlarged, diminished, or significantly changed, and <br /> in the event of such notification of change, it shall lose the protection as a historically significant sign. <br /> <br /> The Historical Signs are as follows: <br /> <br /> 1. House Jewelry sign located on the East Plaza. <br /> 2. 100E Lodge sign located at the corner of Grand and 1st S.W., and the arrow sign on the back portion <br /> east side of this building. <br /> 3. Tropic Restaurant sign located in the 100 block of Bonham. <br /> 4. American Legion sign located on 2nd N.E. <br /> 5. The three sign structures located on 1st S. E. and Lamar. (The sign message must be removed.) <br /> <br /> According to Sign Ordinance 2008-021, Section 28-21(b) (1) Abandoned or obsolete signs. Any sign <br /> now or here after existing which no longer advertises a bona fide business conducted or a product sold <br /> at said premises, shall be removed by the owner, agent, or person having the beneficial use of the <br /> building or structure upon which the sign may be found or associated within twelve(12) months after the <br /> said business has been closed; provided, however, if the premises containing the sign is leased, such <br /> sign shall be removed within twenty-four (24) months after the most recent tenant ceases to operate on <br /> the premises. <br /> <br /> By nominating these signs the City Council will protect them from removal, enabling these important <br /> pieces of history to remain and be preserved. If the City Council chooses not to nominate the signs the <br /> property owner will be required to remove the sign by ordinance. <br /> BOARD/COMMISSION RECOMMENDATION: <br /> The Historic Preservation Commission has nominated the previous listed signs as historic signs.
