CITY COUNCIL AGENDA ITEM BRIEFING SHEET

Submittal Date: Originating Department: Presented By: Agenda Item No.:
03/26/2011
Council Date: Police Chief Hundley 13.
05/09/2011
RECOMMENDED MOTION:
This ordinance was previously tabled. Motion to approve as presented.
POLICY ISSUE(S):
Wrecker Ordinance
BACKGROUND:
Councilman Pickle and Chief Hundley met with the `on-call' wrecker services on Wednesday, April 27 th to
discuss the ordinance and specifically the proposed wrecker fee schedule. From the meeting:
• There is not a `set' fee schedule by the agency which regulates tow trucks, the Texas Department of
Licensing and Regulation, commonly referred to as TDLR.
• The only requirement from TDLR is for the wrecker service to post their fee schedule on the public
TDLR website.
• These on-call wrecker services are for profit companies, but also provide public service by assisting
at collision scenes and opening blocked roadways.
• The wrecker services pointed out the cities manner of charging individuals for fire and EMS
response by specific equipment or service used on vehicle collisions.
• After listening to the concerns from the services regarding the cost of doing business, the fee
schedule that is being recommended is the wrecker services legally posted fees.
• There was discussion regarding the Pitcock / Roberts wrecker service, in which Pitcock
incorporated owns both services, therefore receives an additional on call rotation day and the fact of
this service having only one heavy duty wrecker. TDLR was contacted and verified that the two
services each have their own permit number and the fact of them sharing the one heavy duty
wrecker which is owned by the corporation is not in violation of any TDLR rules. Since the
ordinance being presented follows TDLR regulations, there is no violation of any part of the
proposed ordinance for this use of the heavy duty wrecker for both services which are owned by the
same corporation.

BOARD/COMMISSION RECOMMENDATION:

EXHIBITS:
Ordinance, Wrecker Rules (2 pages), Fee Study
ACTION: BUDGET INFO:
❑ Financial Report ❑ Minute Order Expense $
❑ Department Report ❑ Resolution Budgeted Amt. $
❑ Presentation ® Ordinance YTD Actual $
❑ Public Hearing ❑ Other Acct.
