WHEREAS, in conformance with the Texas Election Code, said election was <br />conducted on one of the uniform election dates set out in the Election Code, the next <br />available uniform election date being the second Saturday in May 14, 2011; and, <br />WHEREAS, as required by order of the District court of the United States for the <br />Eastern District of Texas, Paris Division, in Civil Action No. P-75-3-CA, and as provided in <br />the Charter of the City of Paris and the laws of the State of Texas, such election was <br />conducted and held at the specified and designated polling places for all seven (7) Districts <br />in the City of Paris and early voting was conducted at the Lamar County Courthouse Annex <br />Paris, Texas; and, <br />WHEREAS, sealed returns of said election for all seven (7) Districts, made by the <br />duly appointed and designated election officials of and for the respective voting boxes, <br />having been made to the Mayor and City Council of the City of Paris, as required by law, <br />which returns after due and deliberate review and canvass thereof, show the results as <br />summarized herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby <br />in all things approved and adopted herein. <br />Section 2. That a special election was held city-wide in all Council Districts of the <br />City of Paris, Texas on Saturday, May 14, 2011 for the purpose of submitting to the <br />qualified voters of the City of Paris one proposition calling for the adoption of an ordinance <br />prohibiting the City of Paris from privatizing the collection, handling, and disposition of <br />residential garbage, trash, and rubbish and providing for the method of fixing charges for <br />such service in the form as follows: <br />"PROPOSITION N0.1 <br />"An Ordinance maintaining the residential solid waste collection with <br />the City of Paris; requiring City equipment and employees to be used for <br />such service; and requiring the City Council to set a monthly rate for <br />residential garbage handling and disposal 6ased on employee cost, <br />equipment cost, landfill cost, and billing cost." <br />❑ Forthe Ordinance ❑ Against the Ordinance <br />Section 3. That, a canvass of the returns of the special election and a tabulation of <br />the votes cast therein for and against Proposition No. 1, reflect that a majority of the <br />qualified voters of the City of Paris, Texas, voted "For" Proposition No. 1. A copy of the <br />tabulation is attached hereto as Exhibit "A." <br />
