WHEREAS, in conformance with the Texas Election Code, said election was conducted on one of the uniform election dates set out in the Election Code, the next available uniform election date being the second Saturday in May 14, 2011; and, WHEREAS, as required by order of the District court of the United States for the Eastern District of Texas, Paris Division, in Civil Action No. P-75-3-CA, and as provided in the Charter of the City of Paris and the laws of the State of Texas, such election was conducted and held at the specified and designated polling places for all seven (7) Districts in the City of Paris and early voting was conducted at the Lamar County Courthouse Annex Paris, Texas; and, WHEREAS, sealed returns of said election for all seven (7) Districts, made by the duly appointed and designated election officials of and for the respective voting boxes, having been made to the Mayor and City Council of the City of Paris, as required by law, which returns after due and deliberate review and canvass thereof, show the results as summarized herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved and adopted herein. Section 2. That a special election was held city-wide in all Council Districts of the City of Paris, Texas on Saturday, May 14, 2011 for the purpose of submitting to the qualified voters of the City of Paris one proposition calling for the adoption of an ordinance prohibiting the City of Paris from privatizing the collection, handling, and disposition of residential garbage, trash, and rubbish and providing for the method of fixing charges for such service in the form as follows: "PROPOSITION N0.1 "An Ordinance maintaining the residential solid waste collection with the City of Paris; requiring City equipment and employees to be used for such service; and requiring the City Council to set a monthly rate for residential garbage handling and disposal 6ased on employee cost, equipment cost, landfill cost, and billing cost." ❑ Forthe Ordinance ❑ Against the Ordinance Section 3. That, a canvass of the returns of the special election and a tabulation of the votes cast therein for and against Proposition No. 1, reflect that a majority of the qualified voters of the City of Paris, Texas, voted "For" Proposition No. 1. A copy of the tabulation is attached hereto as Exhibit "A."
