t <br />( S CHALAIRE SURVEYING, INC. <br />I BOUNDARY • TOPOGRAPHY • CONSTRUCTION <br />May 20, 2011 <br />Re: Request for variance regarding the dedication of rights- of-way along streets adjoining the <br />proposed Burress 128 addition. <br />The City of Paris, <br />Joe Burress, the developer, hereby requests a variance from the requirement for the dedication of rights-of-way <br />along the south side of Bonham Street, the west side of 12th Street SW, and the east side of 13th Street SW, all <br />adjacent to the proposed Burress 128 addition to the City of Paris. The primary reason for this is that the <br />current dimensions of the property severely limit what can be built on it, and making it smaller by the <br />requested amounts may eliminate the economic viability of the property altogether. In addition, there aze <br />physical obstacles to widening the roads adjacent to the property. <br />Regxrding the right-of-way of Bonham Street, a 12.5-foot dedication along the north side of the property is <br />requested to bring the width of the south half of the Bonham Street right-of-way to 40 feet, in compliance with <br />the requirements of its classification as an arterial street. However, eacisting buildings east, west, and north of <br />the proposed addition do not allow for the possibility of an 80-foot right-of- way in this azea. West of the <br />property, the porch an the house located at 1225 Bonham Street is 46.3 feet from the existing pavement center <br />line; east of the property, the north side of the Dadant & Sons brick building located at 1169 Bonham Street is <br />54.8 feet south of the existing north right-of-way line of Bonham Street; and north of the property, the <br />buildings located at 1200, 1204, and 1220 Bonham Street lie between 28 feet and 30 feet north of the existing <br />center line of Bonham Street, all of which constitute physical barriers to increasing the width of Bonham <br />Street. A 2.5-foot dedication aioag the south side of Bonham Street is proposed on the plat to bring its <br />width into compliance with the requirements for a collector-level street. <br />Regarding the right-of-way of 12"' Street SW, a 5-foot dedication is requested. Adjacent to the east side of <br />City Btock 128, the pavement on 12`h SW is currently 30.8 feet wide with concrete curb and gutter, and there <br />are no houses currently fronting 12'h SW from Bonham Street south to its terminus at Sherman Street. <br />Therefore, the existing pavement width should easily accommodate the traffic on this street for decades to <br />come. <br />Regarding the right-of-way of 13"' Street SW, a 10-foot dedication is requested. This street is one block <br />long, lying between Bonham Street and Kaufman Street, and there are no houses or businesses fronting it. <br />South of the property, the house located at 1214 Kaufman Street is only 14.5 feet east of the eacisting center <br />line of the pavement, coustituting a physical impediment to the widening of the street. <br />To accommodated futare needs of pub6c and private utilities in the area, a 5-foot atility easement is <br />proposed abng the east, north, and west sides of the addition. <br />In conclusion, Mr. Burress asserts that reducing the size of this small lot any further will prevent its <br />development, and that the locations of existing structures north, south, east, and west of the property prevent <br />the expansion of the streets adjacent to the proposed addition; therefore, he requests relief from the <br />requirements to dedicate 12.5 feet of right-of-way along Bonham Street, and a total of 15 feet of right-of-way <br />along 12'h Street SW and 13t° Street SW.
