Director of <br />Council Date: <br />Development <br />Engineering, Planning & <br />18. <br />07-25-2011 <br />Develo ment <br />RECOMMENDED MOTION: <br />Deliberate and possibly act on repealing the current Chapter 13 Flood Damage Prevention of the Code <br />of Ordinance and adopting a modified version of the Flood Damage Prevention Ordinance as provided <br />to the City by the Texas Water Development Board and FEMA. <br />POLICY ISSUE(S): <br />FEMA National Flood Insurance Rate Maps and Ordinance <br />BACKGROUND: <br />The Federal Emergency Management Agency (FEMA) has recently completed changes to our <br />floodplain maps. The new maps are tentatively set to become effective August 16, 2011. This new <br />ordinance will replace the existing ordinance. The new ordinance has higher standards than our existing <br />ordinance. The major change in the ordinance provided to us is a more stringent requirement for all new <br />structures and substantial improvements to be constructed at least two (2) feet above the base flood <br />elevation. The old requirement was a minimum of one (1) foot above the base flood elevation. The <br />base flood elevation is the elevation shown on the Flood Insurance Rate Map (FIRM) and found in the <br />Flood Insurance Study (FIS) that indicates the water surface elevation resulting from the flood that has a <br />1% chance of equaling or exceeding that level in any given year. <br />The change in the requirement for all new construction or substantial improvement to be at least two (2) <br />foot above the base flood elevation is a recommendation not a requirement. This could be changed back <br />to one (1) foot if the Council elects to do so. One possible advantage to requiring a minimum of two (2) <br />feet above the base flood elevation is that it could be possible to do a Letter of Map Amendment-F and <br />remove the house from the floodplain.
