ORDINANCE NO. 2011-024 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING CHAPTER 13, FLOOD DAMAGE PREVENTION AND CONTROL OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS TO ADOPT A REVISED FLOOD DAMAGE PREVENTION ORDINANCE BASED ON THE FEDERAL EMERGENCY MANAGEMENT AGENCY'S (FEMA) MODEL FLOODPLAIN MANAGEMENT ORDINANCE; DESIGNATING A FLOODPLAIN ADMINISTRATOR; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Texas has in the Flood Control Insurance Act, Texas Water Code, Section 16.315, delegated the responsibility of local governmental units to adopt regulations designed to minimize flood losses. Therefore, the City of Paris, Texas does ordain as follows: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Chapter 13 of the Code of Ordinances of the City of Paris, Texas, entitled "Flood Damage Prevention and Control," be, and is hereby, repealed and declared null and void and of no further effect. Section 3. That a new Chapter 13 of the Code of Ordinances of the City of Paris, Texas, be, and is hereby, adopted so that such shall read as follows: FLOOD DAMAGE PREVENTION ORDINANCE ARTICLE I. IN GENERAL Sec. 13-1 Statutory Authorization The Legislature of the State of Texas has in the Flood Control Insurance Act, Texas Water Code, Section 16.315, delegated the responsibility of local governmental units to adopt regulations designed to minimize flood losses. Therefore, the City of Paris, Texas does ordain as follows:
