Draft <br />S:\citydata\Attorney\ordwork\library ordinance 9-26-11 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING CHAPTER 20 LIBRARY OF THE CODE OF ORDINANCES OF <br />THE CITY OF PARIS,TEXAS, BY ADDING A NEW SECTION 20-4, LIBRARY <br />USER FEES, TO SET ANNUAL FEES FOR NON-PARIS RESIDENT USERS OF <br />THE PARIS PUBLIC LIBRARY; SUCH FEES WOULD REPRESENT THE COST <br />OF OBTAINING A LIBRARY CARD WHICH IS NECESSARY TO CHECK OUT <br />MATERIALS FROM THE LIBRARY OR USE THE PUBLIC COMPUTERS <br />LOCATED IN THE LIBRARY; MAKING OTHER FINDINGS AND PROVISIONS <br />RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A <br />SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, annual maintenance and operation of the Paris Public Library is funded <br />in part by property taxes paid by the residents of the City of Paris; and <br />WHEREAS, the City Council finds that patrons of the Paris Library who reside <br />outside the city limits and therefore do not pay any municipal property taxes in support of <br />the City Library should be assessed a reasonable fee to defray in part the cost of <br />maintaining and operating said library. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this ordinance are hereby <br />in all things approved. <br />Section 2. That a new Section 20-4, Library User Fees, be added to Chapter 20, of <br />the Code of Ordinances of the City of Paris, Texas, to assess an annual fee for use of the <br />library by patrons who reside outside the corporate city limits of the City of Paris, said <br />Section 20-4 to read as follows: <br />"Sec 20-4 Annual fee for library patrons whose primary residence is located outside of <br />the corporate city limits of the City of Paris. <br />All persons who wish to check out books or other materials from the Paris <br />Public Library and those persons wishing to use the Library computers must possess a valid <br />library card issued by Paris Public Library. Gibrary patrons whose primary residence is <br />located outside the corporate city limits of the City of Paris are required to pay an annual user <br />fee as follows: <br />55 <br />
