Special City Council Meetrng <br />July 27, 2004 <br />Page 15 <br />other cities has been looked at before and most have the 2 to 1 match and some <br />have a 7% match instead of a 6% match. <br />Mayor Fendley called for a break at 7:45 p.m before reconvening in Executive <br />Session. <br />Mayor Fendley convened the Council into Executive Session at 8:50 p.m. <br />pursuantto Section 551.071 ofthe Texas Government Code, Consultation with <br />Attorney, to receive advice of legal counsel pertaining to pending or possible <br />litigation and to receive advice of legal counsel pursuant to the duty of an <br />attorney to his client under the Texas Disciplinary Rules of Professional <br />Conduct of the State Bar of Texas, regarding appropriate legal action for the <br />collection of delinquent franchise fees from TXU Gas Company. <br />Mayor Fendley closed the Executive Session at 9:06 p.m. and reconvened the <br />open session at 9:08 p.m. <br />Councilman Wilson made a motion to authorize City Attorney Schenk to go <br />forward to resolve the suit against TXU Gas Company as discussed in <br />Executive <br />Session. <br />Councilwoman Wilson asked Mr. Anderson how many employees work for the <br />city but live outside of the city limits and don't pay taxes.
