DRAFT <br />H:JANICE\RESOLUTIONS\CURRENT\ ESTABLISHING COMPUTATION OF OVERTIME - 2004 <br />October 11, 2004 <br />RESOLUTION NO. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, ESTABLISHING A TWENTY-EIGHT (28) DAY, TWO- <br />HLTNDRED AND TWELVE (212) HOUR WORK PERIOD FOR <br />COMPUTATION OF OVERTIME FOR DESIGNATED FIREFIGHTER AND <br />EMERGENCY MEDICAL SERVICES PERSONNEL; DESIGNATING THE <br />EFFECTIVE PAY PERIOD FOR SAID CHANGE; PROVIDING A <br />REPEALER; MAKING OTHER FINDINGS AND PROVISIONS RELATED <br />TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE FOR SAID <br />RESOLUTION. <br />WHEREAS, the City Council of the City of Paris, Paris, Texas, has reviewed the options <br />available to said Council pursuant to state and federal law for the payment of overtime to certain <br />designated firefighter and emergency medical services personnel; and, <br />WHEREAS, the City Council desires to designate a work period for said personnel for <br />purposes of computation of overtime in accordance with the Fair Labor Standards Act of 1938, <br />29 U. S. C. § 201 et seq., and especially 29 U. S. C. § 207 (k), and Section 142.0015 of the Texas <br />Local Government Code; NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COLTNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. That the findings set out in the preamble to this resolution are hereby in all <br />things approved. <br />Section 2. That in accordance with the provisions of the Fair Labor Standards Act of <br />1938, 29 U. S. C. § 201 et seq., and specifically 29 U. S. C. § 207(k), and the provisions of Section <br />142.0015 of the Texas Local Government Code, and beginning the pay period specified herein, <br />computation of overtime for City of Paris non-exempt, non-civilian, certified firefighters who are <br />engaged in fire suppression (but not fire prevention) activities, and non-exempt, non-civilian, <br />certified emergency medical services personnel who are engaged in emergency ambulance (but <br />not transfer ambulance) activities, shall be on the basis of hours worked in excess of two-hundred <br />and twelve (212) hours in a twenty-eight (28) day work period. <br />Section 3. That payment of overtime in conformance with this resolution sha11 initiate <br />beginning that pay period dated October 23, 2004, and sha11 continue thereafter in conformance <br />with this resolution until amended or advised by action of the City Council. <br />
