AGREEMENT FOR GROUNDS MAINTENANCE <br />STATE OF TEXAS § <br />§ KNOW ALL MEN BY THESE PRESENTS: <br />COUNTY OF LAMAR § <br />THAT, the CITY OF PARIS, TEXAS, a home rule municipal corporation,1351 st Street SE, <br />Paris, TX 75460, (hereinafter called "CITY"), and CHUCK RAY DB/A/ RAY' S LAWN SERVICE <br />695 N. Cedar, Blossom, Texas (hereinafter called "CONTRACTOR"), do hereby contract and agree <br />as follows: <br />This Agreement shall become effective upon execution by both parties and the effective date <br />shall be the date executed by the Paris City Manager on behalf of the City of Paris. <br />2. The following documents attached hereto and incorporated herein as Exhibits A, B& C are <br />made a part of this Agreement and shall be referred to collectively as "Contract Documents". <br />Exhibit A Mowing Specifications <br />Exhibit B Notice to Bidders <br />Exhibit C Bid Form submitted by CONTRACTOR <br />3. The initial term of this Agreement shall begin on the effective date herein and shall end on <br />December 31, 2011. Therefore, the Agreement may be renewed for up to three (3) additional <br />twelve (12) month terms by written agreement of the parties. <br />4. CONTRACTOR hereby agrees to provide grounds maintenance services for the City of Paris <br />in accordance with the Mowing Specifications attached hereto as Exhibit A, and any <br />amendment thereto, the Notice to Bidders (Exhibit B), and the Contractor's Bid Form <br />(Exhibit C); provided, however, that in the event of perceived conflict or ambiguity among <br />the contract documents, the provisions of this Agreement, the Mowing Specifications, the <br />Invitation to Bid and the Bid Form shall control, in that order. <br />5. CONTRACTOR shall invoice CITY for work performed under this Agreement (at least once <br />per month during peak mowing season) using the unit prices provided by CONTRACTOR in <br />Exhibit C attached hereto. The CITY will pay for all work performed in accordance with this <br />Agreement and accepted by the CITY within thirty (30) days of receipt and approval of <br />invoice. <br />6.
