<br />DRAFT <br /> <br />F:ALICEIRESWORKICURRENTlElevated Water Storage Tank - Close Contract Res <br />December 8, 2004 <br /> <br />RESOLUTION NO. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, APPROVING RELEASE OF RETAINAGE AND FINAL <br />ACCEPTANCE OF THE PROJECT PURSUANT TO THE CITY'S <br />CONSTRUCTION CONTRACT WITH CHICAGO BRIDGE AND IRON <br />CONSTRUCTORS, INc. FOR THE CONSTRUCTION OF THE 2.5 <br />MILLION GALLON ELEVATED WATER STORAGE TANK; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of Paris did heretofore, on the 14th day of <br />October, 2002, in Resolution No, 2002-060, award Contract for construction of the 2,5 million <br />gallon elevated water storage tank to Chicago Bridge & Iron Constructors, Inc,; and, <br /> <br />WHEREAS, Bucher, Willis & Ratlif Corporation, acting as project engineer, <br />recommends closing the contract with Chicago Bridge & Iron Constructors, Inc, by making final <br />payment of retain age in the amount of$10,000 as shown in Exhibit A attached hereto; NOW, <br />THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br /> <br />Section 1. That the findings set out in the preamble of this resolution are hereby in all <br />things approved, <br /> <br />Section 2. That the payment of retain age in the amount of$10,000 and acceptance of the <br />project pursuant to the City's construction contract with Chicago Bridge & Iron Constructors, <br />Inc, for construction of the 2,5 million gallon elevated water storage tank as shown on Exhibit <br />A attached hereto, be, and the same is hereby, approved, <br /> <br />Section 3.
