<br />DRAFT <br /> <br />of a local government must provide the same or better level of health insurance benefits to a public <br />safety officer who retires or is separated from service, as a direct or proximate result of a personal <br />injury sustained in the line of duty while responding to a hot pursuit or emergency situation, as the <br />officer was receiving while on active duty. <br /> <br />SECTION 14.191 Definitions <br /> <br />. <br /> <br />Emergency situation is defined as, "any situation in which life or property is in danger." <br /> <br />Firefighter is defined as, "an individual serving as an officially recognized or designated <br />member of a legally organized volunteer fire department of an officially recognized or <br />designated public employee member of a rescue squad or ambulance crew." <br /> <br />. <br /> <br />. <br /> <br />Law enforcement officer is defined as, "an individual involved in crime and juvenile <br />delinquency control or deduction, or enforcement of the laws including, but not limited to <br />police, correction probation, parole and judicial officers." <br /> <br />. <br /> <br />Public agency is defined as, "the United States, any State of the United States, the District <br />of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, <br />Guam, American Samoa, the Trust Territory of the Pacific Islands, the Commonwealth of <br />the Northern Mariana Islands, and any territory or possession of the United States, or any unit <br />of local government, department, agency, or instrumentality of any of the foregoing." <br /> <br />Public safety officer is defined as, "an individual serving a public agency in an official <br />capacity, with or without compensation, as a law enforcement officer, firefighter, or rescue <br />squad or ambulance crew." <br /> <br />. <br /> <br />SECTION 14.192 - Covera~ <br /> <br />All injuries that are sustained by a law enforcement officer, firefighter, rescue squad or ambulance <br />crew member as a result of a "hot pursuit" or "emergency situation" that is deemed work related by <br />Worker's Compensation will be covered under the Public Safety Officers' Health Benefit Provision <br />if the injury resu1ts in the employee retiring or terminating employment. <br /> <br />39 <br /> <br />Rev. 10/27/04 <br />
