<br />Sec. 28-107. Availability of suitable existing Support Structures, alternative <br />buildings or structures, or alternative technology. <br /> <br />(a) No new WCF shall be permitted unless the applicant demonstrates to <br />the reasonable satisfaction of the Director that no existing Support Structure, or <br />alternative Support Structure, or alternative technology that does not require the use <br />of Support Structures can accommodate the applicant's proposed WCF. An <br />Applicant shall submit any and all information as the City may deem appropriate <br />related to the availability of suitable existing towers and other WCF, other <br />structures, or alternative technology. Information submitted to demonstrate that <br />no existing Support Structure, WCF, or other structure or alternative technology <br />can accommodate the applicant's proposed WCF may evidence any of the <br />following: <br /> <br />(1) <br /> <br />(2) <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br /> <br />(6) <br /> <br />No existing Support Structures or WCF are located within the <br />geographic area which meet applicant's engineering requirements; <br /> <br />Existing Support Structures or other WCF are not of sufficient <br />height to meet Applicant's engineering requirements; <br /> <br />Existing Support Structures or WCF do not have sufficient <br />structural strength to support Applicant's proposed WCF and related <br />equipment; <br /> <br />The Applicant's proposed Support Structure and WCF would cause <br />electromagnetic interference with existing WCF, or the broadcast <br />signal or antenna array on existing WCF or Support Structures <br />would cause interference with the Applicant's proposed WCF; <br /> <br />The fees, costs, or contractual provisions required by the owner of <br />the other structure in order to share an existing Support Structure or <br />WCF or to adapt an existing Support Structure or WCF for sharing <br />are unreasonable. Costs exceeding new Support Structure <br />development are presumed to be unreasonable; <br /> <br />There are other limiting factors that render existing Support <br />Structures, WCF, or an alternate technology unsuitable; <br /> <br />-10- <br />
