Director of <br />Council Date: <br />1-23-2012 <br />& Development <br />Engineering, Planning & <br />Development <br />13. <br />RECOMMENDED MOTION: <br />Request from property owners to disannex approximately 386 acres located in an area East of U.S. 271 <br />North, North of NLISD Property and West of Stillhouse Road (see attached map). <br />POLICY ISSUE(S): <br />Disannexation <br />BACKGROUND: <br />Staff seeks City Council direction on the disannexation request (see attached request). The request that <br />was submitted was not signed by all of the property owners. The two property owners who did not sign <br />the request own Sterling House (6.5 ac.) and Christian Fellowship Church (4 ac.). The area described by <br />the petition is the same legal description used by the City of Paris to annex the property on Apri126th, <br />1999. This area was annexed by the City of Paris prior to September l, 1999, the date the State <br />Legislature passed new Annexation laws requiring municipalities to prepare service plans and <br />committing to full infrastructure development in the annexed area within a 2.5 year period. <br />Petitioner states in bullet point number 3 of his petition that the land should be disannexed because the <br />City has not provided municipal services to the area, but in reality the city has provided water and sewer <br />services to tracts in that area as they have developed Police, Fire and EMS services have been provided <br />to entire annexed area since April 26, 1999 (date of annexation). <br />Attached is a spread sheet that shows the properties included in the legal description that list the area, <br />market value and taxes paid. The majority of the taxes paid in the area are paid by Sterling House. <br />These ad valarem taxes are used to fund the general fund, not the water and sewer fund. <br />Staff recommends that the entire area/developed and undeveloped acreage remain inside the City limits. <br />When developed these areas will have a significant impact on the City's tax base.
