DRAFT F:ALICE\RESWORK\CURRENT\ Landscaping Contract Termination Res February 7, 2005 RESOLUTION NO. __________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, AUTHORIZING NOTICE OF TERMINATION OF THE CITY’S CURRENT AGREEMENT FOR GROUNDS MAINTENANCE WITH JACKIE GOOD D/B/A GOOD TREE SERVICE AND/OR GLOVER LAWN MAINTENANCE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Manager has proposed to the City Council alternative approaches to maintain publicly-owned grounds other than by simply mowing; and, WHEREAS, the City Council desires to pursue these alternative methods for grounds maintenance and to seek competitive bids for the revised procedures incumbent thereto; and, WHEREAS, the City’s current agreement for grounds maintenance with Jackie Good d/b/a Good Tree Service, including any subcontracting of same to Glover Lawn Maintenance, provides for the City to terminate the agreement at any time upon sixty (60) days written notice to the other party; and, WHEREAS, the City Council desires to so terminate said contract and seek new competitive NOW, THEREFORE, bids for the aforesaid service; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Manager and he is hereby authorized to send notice of termination to Jackie Good d/b/a Good Tree Service and/or any subcontractor, including Glover Lawn Maintenance, currently providing service to the City pursuant to that agreement authorized by Resolution No. 2003-110, approved June 16, 2003, for services to commence on June 18, 2003, such notice of termination to be effective sixty (60) days following receipt thereof in accordance with the aforesaid agreement. Section 3. That the City Manager be and he is hereby authorized to prepare new bid specifications for said ground maintenance services and to seek competitive bids utilizing the aforesaid new specifications. Section 4. That this resolution will be effective from and after its date of passage.
