<br /> <br /> <br /> <br /> <br /> GROUND LEASE AGREEMENT <br /> <br /> <br /> COUNTY OF LAMAR ) <br /> KNOW ALL MEN BY THESE PRESENTS: <br /> STATE OF TEXAS ) <br /> <br /> THIS LEASE AGREEMENT is made this 22nd day of June, 2009, by and between the <br /> CITY OF PARIS, TEXAS, a home rule municipal corporation, acting by and through its City <br /> <br /> Manager, Kevin Carruth, duly authorized, hereinafter referred to as LESSOR, and William T. <br /> Boothe, 2563 CR 43200, Powderly, Lamar County, Texas 75473, hereinafter referred to as <br /> <br /> LESSEE. <br /> WITNESSETH <br /> <br /> For and in consideration of the construction of a new airplane hangar, concrete apron and <br /> related improvements as further described herein and the payment of the monthly ground lease <br /> <br /> rental to the LESSOR as provided herein LESSOR does hereby lease, rent, and let unto LESSEE <br /> that portion of Cox Field real property more particularly described in Exhibit "A," attached hereto <br /> <br /> and made a part hereof for all purposes, hereinafter referred to as the property or leased premises. <br /> LESSEE hereby leases the leased premises from LESSOR subject to the terms, covenants <br /> and conditions stated below, and shall have the right and privilege to construct and maintain <br /> <br /> certain improvements as described herein on the leased premises. <br /> LESSEE has inspected the leased premises to his satisfaction and accepts the Leased <br /> <br /> Premises in its present ("as-is") and ("where-is") condition unless expressly noted otherwise in <br /> this Lease. LESSOR its officers, employees and agents make no express or implied warranties as <br /> <br /> to the condition or fitness for a particular purpose of the leased premises. LESSEE must satisfy <br /> itself that the leased premises may be used as LESSEE intends by independently investigating the <br /> <br /> property and all matters related to the use of the leased premises. LESSEE agrees that it has not <br /> relied on any warranty or representation made by LESSOR concerning the condition of the leased <br /> <br /> premises or the fitness of the leased premises for any particular purpose. <br /> LESSEE shall be solely responsible for maintenance of the leased premises and for <br /> <br /> providing insurance coverage on the leased premises and any improvements thereon upon the <br /> effective date of this Lease. <br /> <br /> <br /> <br /> Han¢ar Lease Agreement - page 1 <br /> <br /> <br /> <br /> <br /> 189 <br />
