DRAFT F:ATTORNEY\RESWORK\CURRENT\Herbicide Ratify/Repeal Res June 7, 2005 RESOLUTION NO. __________ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, RATIFYING OR REPEALING THE PRIOR AWARD OF THE BID AND AUTHORIZATION FOR A CONTRACT FOR THE FURNISHING AND DELIVERY OF LABOR, MATERIALS, AND EQUIPMENT AND FOR PERFORMING ALL WORK REQUIRED FOR APPLYING HERBICIDES ON CITY OF PARIS PROPERTY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris on May 23, 2005, did by adoption of Resolution No. 2005-059, authorize the award of the contract for the furnishing and delivery of labor, materials, and equipment and for performing all work required for applying herbicides on City of Paris property, conditioning such award on the City satisfactorily addressing the issue of actions taken by the contractor on grass surrounding the City Plaza; and, WHEREAS, the City Manager desires to allow the City Council to reconsider its award NOW, THEREFORE, based on further information presented to the Council by the Manager; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the City Council does hereby ratify/repeal Resolution No. 2005-059, adopted May 23, 2005, which awarded the bid and authorized a contract for the furnishing and delivery of labor, materials, and equipment for performing all work required for applying herbicides on City of Paris property, such ratification/repeal to be without condition. Section 3. That this resolution shall be effective from and after its date of passage.
