AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING AND AUTHORIZING A SOLID WASTE AGREEMENT BETWEEN THE CITY OF PARIS AND WASTE MANAGEMENT OF TEXAS, INc., FOR THE COLLECTION, HAULING, AND DISPOSAL OF RESIDENTIAL SOLID WASTE WITHIN THE CITY LIMITS OF THE CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Paris as a Home Rule City is authorized under state law to regulate and control solid waste collection and disposal within its city limits; and, WHEREAS, Section 12 of the City Charter of the City of Paris authorizes the City Council by ordinance to adopt and prescribe rules and regulations and fix charges and compensation to be charged for the removal, handling, and disposition of all garbage, trash, and rubbish within the city limits of the City of Paris; and, WHEREAS, Section 16-21 (b) of the Code of Ordinances ofthe City of Paris designates the City as the exclusive provider of residential garbage, rubbish, and waste collection and disposal services for all residential units within the City Limits of the City of Paris; and, WHEREAS, the City Council has identified a short-fall in the general revenues of the City of Paris and specifically a short-fall in the revenues generated for solid waste collection; and, WHEREAS, the City Council has authorized the City Manager to initiate various actions intended to generate additional revenue or reduce cost to the City operations; and, WHEREAS, among those activities considered by the City Council for the City Manager to pursue is a contract related to collection and disposal of solid waste; and, WHEREAS, the City Manager has sought proposals from various qualified waste disposal firms related to various arrangements for the collection and disposal of solid waste in the City of Paris; and, WHEREAS, as a result of the process of competitive pricing and negotiation, the City Manager has received a proposal from Waste Management, Inc" the nation's largest waste management company, to contract for residential solid waste disposal service within the City, whereby the City would continue to provide customer billing and account control and Waste Management, Inc, would provide the remainder of the services; and,
