<br />20. EVIDENCE OF INSURANCE: Contractor shall procure and maintain for <br />the duration of the Agreement, with a carrier reasonably acceptable to City, insurance <br />against claims for injuries to persons or damages to property, which may arise from or in <br />conjunction with the performance of the work hereunder by the Contractor, his agents, <br />representatives, employees, or subcontractors. The policy or policies shall name the City <br />as an additional insured and shall contain a clause that the insurer will not cancel or <br />decrease the insurance coverage without first giving the City thirty (30) days notice in <br />writing. City may require that the limits stated herein be raised in the event liability of <br />municipal governments is increased by amendment to the current statutes, or any other <br />State or Federal legal requirement. INDEMNITY: Contractor shall defend, indemnify and hold harmless <br />the City, its officers, and employees from and against any and all suits, actions, legal <br />proceedings, claims, demands, losses or damages of any character and from all <br />costs, expenses, and attorneys fees arising as a result of Contractor's performance <br />or non-performance of this Agreement, including but not limited to such actions to <br />the extent caused by the negligent act or omission of the Contractor, its agents, <br />representatives, officers, or employees, in the performance of this Agreement. <br />Contractor will not be responsible for the negligence of City, or any of its agents, <br />employees, or Customers . <br /> <br />SOLID WASTE AGREEMENT <br /> <br />Page 13 <br />
