Elcan for <br />a change in zoning from an Agricultural District (A) to a General <br />Retail District (GR) on Lot 6, City Block 313, being number 3850 <br />Lamar Avenue. <br /> <br />Reeves Hayter advised that his firm prepared the plat; therefore, he <br />would have to recuse himself from the deliberations, which means <br />that when he does, there would be no quorum. <br /> <br />Chairman Hayter stated that he can conduct the public hearing <br />process but the Commission would not be able to vote on the issue. <br />Mr. Hayter suggested that the Commission table this item and set a <br />special meeting, May 9, 5:00 p.m., right. before the City Council <br />meeting to consider this item. <br /> <br />The public hearing was declared open. <br /> <br />Thomas E. Latham, 51 Oakland Avenue, Mobile, AL, was present on <br />behalf of B.D. T. Investment, LLC. They have purchased a 10-acre <br />tract from Wayne Lowe for which they are presently under contract. <br />They are proposing to subdivide the property into two (2) pieces with <br />the front being approximately three (3) acres and the back being 6.5 <br />acres. The three (3) acres line up with the adjacent parcel to the east <br />of this parcel that is zoned Agriculture. The 10-acre tract is presently <br />zoned Agriculture. They would like for the Planning and Zoning <br />Commission to approve the rezoning of the front three (3) acres to <br />General Retail, not asking that the rear piece be rezoned. There are <br />no plans now or in the future to do anything with the rear piece of <br />property. They would like to get the utilities that are on the property <br />to the front piece of the property. The intention is to provide a retail <br />center consisting of five (5) national retailers. The retail center would <br />create 10-15 jobs. Three (3) tenants are under contract, subject to <br />rezoning and approval of the plat. Upon approval, plans are in place <br />
