<br />DRAFT <br />[F:ATTORNEY\ORDWORK\CURRENT\ Amend Sec 34-23(c) Adjust Surcharges Ord <br />July 6, 2005 <br />ORDINANCE NO. __________ <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, AMENDING SECTION 34-23 (c) OF THE CODE OF <br />ORDINANCES OF THE CITY OF PARIS TO ADJUST SURCHARGES <br />APPLICABLE TO WASTEWATER DISCHARGES WHICH EXCEED <br />ACCEPTABLE LIMITS, IN ACCORDANCE WITH THE CITY’S RECENT <br />RATE STUDY, AND TO OMIT CERTAIN OBSOLETE LANGUAGE <br />REGARDING CALCULATION OF RATES; MAKING OTHER FINDINGS <br />AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, <br /> in accordance with state and federal regulations, the City of Paris as a publicly <br />owned treatment works is required to treat municipal sewerage as well as sewerage from other <br />sources whose strength exceeds the ordinary or permissible limits for municipal sewerage; and, <br />WHEREAS, <br /> additional costs are incurred by the City in treating such excessive strength <br />sewerage; and, <br />WHEREAS, <br /> in conformance with state and federal regulations, the City assesses a surcharge <br />which is charged the generator of such excessive strength sewerage to defray the additional cost <br />incurred by the City in treating such excessive strength sewerage, such surcharge being based on the <br />strength of biochemical oxygen demand (BOD), total suspended solids (TSS), and ammonia (NH); <br />3 <br />and, <br />WHEREAS, <br /> the City has not adjusted its excessive strength surcharge rate since 1999; and, <br />WHEREAS, <br /> the City has recently conducted a rate study based on the City’s cost of treating <br />such waste, and said rate study supports implementation of increased excessive strength surcharge <br />rates to adequately and accurately compensate the City for its cost in treating such waste; and, <br />WHEREAS, <br /> the City Council desires to increase such surcharge rates to accurately reflect <br />NOW, THEREFORE, <br />the cost incurred by the City in such treatment; <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, <br />TEXAS: <br />Section 1. <br /> That the findings set out in the preamble to this ordinance are hereby in all things <br />approved. <br />Section 2. <br /> That Section 34-23 (c) of the Code of Ordinances of the City of Paris, the same <br />being “Sewer rates – For customers using city water”, shall be and is hereby in all things amended to <br />increase the excessive strength sewer charge rate stated therein and to omit certain language no <br /> <br />
