Director of <br />Council Date: <br />& Development <br />Engineering, Planning & <br />13. <br />3-26-2012 <br />Development <br />RECOMMENDED MOTION: <br />Request from property owner to disannex approximately 5.025 acres located in at the SE corner of <br />Wildwood Lane and CR 42350 (Smallwood Road). <br />POLICY ISSUE(S): <br />Disannexation <br />BACKGROUND: <br />Staff seeks City Council direction on the disannexation request from Ms. Terri Palmer at 4300 <br />Smallwood Road (see attached request). The State Legislature created a policy that went into effect on <br />September 1, 1999, that requires a city who wants to annex property to develop a service plan to provide <br />infrastructure development into annexed areas within a 2.5 year time period. This area was annexed in <br />1997 by the City of Paris. <br />The following services are provided to the property owner: Water is supplied by Lamar County Water <br />Supply District and all the houses in this area have septic systems. The resident is currently paying the <br />City of Paris for trash pickup. According to the Lamar County Appraisal District the location of the <br />house is inside the Paris City limits. The owner's mailing address is listed as Reno on the property <br />account at the Lamar County Appraisal District. The City limits of the City of Paris are the property <br />owner's northern property line, this means that Smallwood Road is not in the City Limits and is not <br />maintained by the City of Paris.
