ORDINANCE NO. 98-012 <br />AN ORDINANCE CLOSING FIFTEEN (15) FEET OF THE RIGHT-OF-WAY OF <br />THE STREET KNOWN AS PARIS BOULEVARD, BEGINNING WITH THE EAST <br />BOUNDARY LINE OF CHURCH STREET AND ENDING WITH THE WEST <br />BOUNDARY LINE OF 6TH STREET S.E.; DECLARING NO NECESSITY OR NEED OF <br />SAID NIFTEEN (15) FEET OF RIGHT-OF-WAY FOR CITY USE; AND PROVIDING NOR <br />AN EFFECTIVE DATE OF MARCH 23, 1998. <br />WHEREAS, the City Council of the City of Paris did heretofore, on the Sth day of <br />November, 1987, by motion reflected in the minutes, approve the reduction of the right-of-way <br />width of Paris Boulevard, between Church Street and 6th Street S.E., froin eighty (80) feet to <br />sixty (60) feet, retaining ten (10) feet for utility easement; and, <br />WHEREAS, the City Engineer has determined that existing utilities are within the <br />preserved right-of-way and, therefore, there is no need to retain a utility easement in addition to <br />the preserved sixty (65) foot right-of-way; and, <br />WHEREAS, it is appropriate that the reduction of the right-of-way width of Paris <br />Boulevard be accomplished by declaring the north fifteen (15) feet of said right-of-way as surplus <br />right-of-way, being of no use for street purposes to the City of Paris or its citizens, and the City <br />Council so finds; NOW, THEREFORE, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />Section 1. That the north fifteen (15) feet of the right-of-way of Paris Boulevard, save <br />and except the eighty (80) foot width of 3rd Street S. E. at its intersection with the north side of <br />Paris Boulevard, between the east boundary line of Church Street and the west boundary line of <br />6th Street S.E., as depictetl on Exllibit A, attached hereto, is found to be of no use as a street to <br />the City of Paris or its citizens; therefore, such street right-of-way is hereby closed. <br />Section 2. This ordinance shall become effective on March 23, 1998. <br />PASSED AND ADOPTED this 23rd day of March, 199 <br />Z;~-; 4:~ <br />Eric S.
