ORDINANCE NO. 98-020 <br />AN ORDINANCE CLO5ING THE SOUTH FIFTEEN (15) FEET OF RIGHT-OF- <br />WAY OF THE STREET KNOWN AS PARIS BOULEVARD, BEGINNING WITH THE <br />EAST BOUNDARY LINE OF CHURCH STREET AND ENDING WITH THE WEST <br />BOUNDARY LINE OF 6TH STREET S.E.; DECLARING NO NECESSITY OR NEED OF <br />SAID FIFTEEN (15) FEET OF RIGHT-OF-WAY FOR CITY USE OTHER THAN FOR A <br />DRAINAGE AND UTILITY EASEMENT, WHICH IS EXPRESSLY RETAINED BY THE <br />CITY OF PARIS; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL 13, 1998. <br />WHEREAS, the City Council of the City of Paris did heretofore, on the Sth day of <br />November, 1987, by motion reflected in the minutes, approve the reduction of the right-of-way <br />width of Paris Boulevard between Church Street and 6th Street S.E. from eighty (80) feet to sixty <br />(60) feet, retaining ten (10) feet for utility easement; and, <br />WHEREAS, it is appropriate that the reduction of the right-of-way width of Paris <br />Boulevard be accomplished by declaring the south fifteen (15) feet of said right-of-way as surplus <br />right-of-way, being of no use for street purposes to the City of Paris or its citizens, but is of use <br />and necessary to the Ciry of Paris and its citizens for drainage and utility easement purposes, and <br />the City Council so finds; NOW, THEREFORE, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />Section 1. That the south fifteen (15) feet of right-of-way of Paris Boulevard, save and <br />except the sixty (60) foot width of both 3rd Street S. E. and Sth Street S. E. at their intersection <br />with the south side of Paris Boulevard, between the east boundary line of Church Street and the <br />west boundary line of 6th Street S.E., as depicted on Exhibit A, attached hereto, is found to be <br />of no use as a street to the City of Paris or its citizens, but is of use and necessary to the City of <br />Paris and its citizens for drainage and utiliry easement purposes; therefore, such street right-of-way <br />is hereby closed. <br />Section 2. This ordinance shall become effective on April 13, 1998. <br />PASSED AND ADOPTED this 13th day of April, 1998. <br />Eric S.
