ORDINANCE NO. 98-042 <br />AN ORDINANCE OF THE CITY OF PARI5, PARIS, TEXAS, PROVIDING THAT <br />THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING <br />SUBSECTIONS (b) AND (c) OF SECTION 34-22 OF SAID CODE TO ESTABLISH WATER <br />RATES FOR RESIDENTIAL, COMMERCIAL, AND INDU5TRIAL CUSTOMER5 THAT <br />IS BASED UPON THE COST TO SERVE EACH CLASS; BY REVISING SUBSECTION <br />(a) OF SECTION 34-23 TO ESTABLISH A SEWER SERVICE RATE FOR CITY WATER <br />CUSTOMERS; BY REVISING SUBSECTION (a) OF SECTION 34-28 TO ESTABLISH <br />DEPOSITS TO ASSURE PAYMENT; PROVIDING FOR A PENALTY NOT TO EXCEED <br />$2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN <br />CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER <br />1, 1998. <br />WHEREAS, on the 15th day of January, 1998, the City Council of the City of Paris, <br />Paris, Texas, received a water and sewer rate study prepared by David M. Griffith and Associates <br />with certain findings and proposed rate increases of 4.6% average for water and 6.4% average for <br />sewer; and, <br />WHEREAS, on the 9th day of February, 1998, a public hearing was had by the City <br />Council of the City of Paris, Paris, Texas, regarding the water and sewer rates; and, <br />WHEREAS, on the 30th day of April, 1998, the City Council was presented with a water <br />and sewer rate study by David M. Griffith and Associates with a proposed rate increase of 4.6 % <br />average for water and 6.4 % average for sewer; and, <br />WHEREAS, on the 19th day of August, 1998, the amendments to the water and sewer rate <br />study were presented by DMG - Maximus (formerly David M. Griffith and Associates), with a <br />proposed rate increase of 4.6% average for water and 6.4% average for sewer; NOW <br />THEREFORE, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />Section 1. That Subsections (b) and (c) of Section 34-22 of the Code of Ordinances of the <br />City of Paris, Paris, Texas, be, and the same are hereby, amended so that such shall read as <br />follows: <br />"Sec. 34-22. Water rates. <br />« <br />"(b) Charges for water furnished by the City, measured in cubic feet, are <br />established as follows based upon customer class and meter size and incorporate a <br />base monthly cost which includes the cost for the first increment of water, and a <br />
