WHEREAS, in conformance with the Texas Election Code, said election was conducted on one of the uniform election dates set out in the Election Code, the next available uniform election date being the second Saturday in September, September 10,2005; and, WHEREAS, as required by order of the District court of the United States for the Eastern District of Texas, Paris Division, in Civil Action No. P- 75-3-CA, and as provided in the Charter of the City of Paris and the laws of the State of Texas, such election was conducted and held at the specified and designated polling places for all seven (7) Districts and early voting of the City of Paris, Paris, Texas; and, WHEREAS, sealed returns of said election for all seven (7) Districts, made by the duly appointed and designated election officials of and for the respective voting boxes, having been made to the Mayor and City Council of the City of Paris, as required by law, which returns after due and deliberate review and canvass thereof, show the results as summarized herein; NOW, THEREFO RE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That a special election was held city-wide in all Council Districts of the City of Paris, Paris, Texas on Saturday, September 10, 2005 for the purpose of submitting to the qualified voters of the City of Paris one proposition calling for the adoption of an ordinance prohibiting the City of Paris from privatizing the collection, handling, and disposition of residential garbage, trash, and rubbish and providing for the method of fixing charges for such service in the form as follows: "Proposition No.1 0 FOR THE ORDINANCE An Ordinance prohibiting the City of Paris from privatizing the collection, handling, and disposition of residential garbage, trash, and rubbish; requiring City equipment and employees be used for such service; requiring the City Council to set a monthly rate for residential garbage handling and disposition based on employee cost, equipment cost, landfill cost, and billing cost; subjecting persons convicted of violating said Ordinance to fines of up to $2,000.00 for each and every days' continuance of violation." 0 AGAINST THE ORDINANCE Section 3 That, in Council District 1, a total of 130 votes were cast regarding Proposition 1 as follows: For Against Early Voting 30 22 District I 66 12 Total Cast T ota} 96 34 130 T I
