<br /> <br /> <br /> <br /> <br /> <br /> (a) Have any of the following characteris- <br /> tics: Toxic, corrosive, chemically reactive, <br /> flammable or combustible, explosive or other- <br /> wise capable of causing substaritial personal <br /> injury or illness. <br /> (b) Pose a substantial hazard to human health <br /> or the environment when improperly treated, <br /> stored, transported or disposed oF, or <br /> otherwise improperly managed. <br /> (c) Be identified or listed as a hazardous <br /> waste in 40 CFR part 261 as defined by the <br /> administrator of the United States Environmen- <br /> tal Protection Agency pursuant to the federal <br /> "Solid Waste Disposal Act" as amended by the <br /> "Resource Conservation and Recovery Act of <br /> 1976" as amended. <br /> Indirect Discharge - The discharge of <br /> nondomestic pollutants from any source regulated <br /> under section 307(B) ar (C) of the Act, (33 USC <br /> 1317) into the POTW (including holding tank waste). <br /> Industrial User - A source ot indirect dis- <br /> charge which does not constitute a"discharge of <br /> pollutants" under regulations issued pursuant to <br /> Section 402 of the Act (33 USC 1342), inciuding the <br /> following: <br /> <br /> (1) A major industry discharging in excess of <br /> two hundred (200) pounds of BOD or suspended <br /> solids per day, or a waste containing toxic or <br /> hazardous material.; <br /> (2) An institution discharging through a <br /> monitoring device; <br /> (3) A light industry discharging less than <br /> two hundred (200) pounds of BOD or suspended <br /> solids per day; or, <br /> <br /> (4) A commercial industry discharging domes- <br /> tic waste, but with the potential to discharge <br /> inciustrial or toxic waste by spillage or <br /> pracess revision. <br /> Industrial Waste - Waste resulting from any <br /> process involve with industry, manufacturing, <br /> trade or business establishments including non- <br /> prorit organizations and government agencies, <br /> concerned with the development of any natural <br /> resource, or any mixture of the waste with water or <br /> domestic wastewater, as distinct from normal <br /> wastewater. <br /> Interference - Any inhibition or disruption of <br /> the POTW treatment processes or operations which <br /> contributes to a violation of any requirements or <br /> limitations of the City's NPDES Permit. The term <br /> also includes any prevention of sludge use or <br /> disposal by the POTW in accordance with Section 405 <br /> of the Act (33 USC 1345) or any criteria, guide- <br /> lines or regulatioris developed pursuant to the <br /> Solid Waste llisposal Act (SWDA), The Clean Air Act, <br /> The Toxic Substances Control Act or more stringent <br /> State Criteria (including those contained in any <br /> state sludge management plan prepared pursuant to <br /> Title IV of SWDA applicable to the methods of <br /> disposal or use employed by the POTGI). <br /> -6- <br />
