<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 91-041 <br /> <br /> <br /> AN ORDINANCE OF THE CITY GF PARIS, PARIS, TEXAS, <br /> PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE <br /> AMENDED BY REPEALING SECTIONS 17-24 AND 17-25, AND DECLARING <br /> SAME TO BE NULL AND VOID AND OF NO EFFECT, AND REVISING <br /> SECTIONS 17-26 and 17-27 OF SAID CUDE; PROVIDING FOR THE <br /> CONFORMATION OF CITY ORDINANCES WITH NEW STATE LAWS; <br /> PROVIDING FOR A PENALTY NQT TO EXCEED $2,000.00; REPEALING <br /> ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; <br /> AND PROVIllING FOR AN EFFECTIVE DATE OF SEPTEMBER 1, 1991. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> Section l. That Sections 17-24 and 17-25 of the Code <br /> of Ordinances of the City of Paris, Paris, Texas, are hereby <br /> repealed and declared null and void and of no effect. <br /> Section 2. That Section 17-26 of the Code of <br /> Ordinances of the City of Paris, Paris, T'exas, be amended so <br /> that such shall read as follows: <br /> <br /> "Sec. 17-26. Correction or removal of conditions <br /> by city-Generally. <br /> (a) If the owner of property in the City of <br /> Paris does not comply with a Sections 17-21, 17-22 <br /> or 17-23, or other requirement under this chapter <br /> within ten (10) days of notice of a violation, the <br /> City may: <br /> (1) do the work or make the <br /> improvements required; and <br /> <br /> ('L) to pay for the work done or <br /> improvements made and charge the expenses to <br /> the owner of the property. <br /> (b) The notice herein required must be <br /> given: <br /> <br /> (1) personally to the owner in writing; <br /> (2) by letter addressed to the owner at <br /> the owner's post office address; or, <br /> <br /> (3) by publication at least twice <br /> within ten (10) consecutive days if personal <br /> service cannot be obtained or the owner's <br /> post office address is unknown." <br /> Section 3. That Section 17-27 of the Code of <br /> Ordinances of the City of Paris, Paris, Texas, be amended so <br /> that such shall read as follows: <br /> <br /> "Sec. 17-27. Same-Filing of statement of <br /> expenses incurred. <br /> (a) The City may assess expenses incurred <br /> under the provisions of Section 17-26, against the <br /> real estate on which the wark is done or <br /> improvements made. <br /> <br /> (b) To obtain a lien against the property, <br /> the mayor, Paris Lamar County Health Department <br /> Sanitation officer, Code Enforcement Officer, or <br /> other city official designated by the mayor must <br /> file a statement of expenses with the county clerk <br /> of Lamar County. <br />
