ORDINANCE N0. 90-044 AN ORDINANCE OF THE CtTY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF URDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTIOlV 4004 UF THE STANDARD FIRE PREVENTION CODE, 1988 ADDITION INCLUDED IN SECTION 12-87 OF SAID CODE; PROVIDING THAT IT SHALL BE UNLAWFUL FOR ANY PERSON TO BURN BRUSH OR TREES OUT OF DOORS IN THE CITY LIMITS wITHOUT A PERMIT; PROVIllING FOR A PENALTY NOT TU EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF NOVEMBER l, 1990. BE IT UKDAINED BY THE CITY CUUNCIL OF THE CITY OF PARIS: Section 1. That the Code of Ordinances of the City of Paris, Paris, Texas, be amended by revising Section 12-87, to read as follows: "Sec. 12-8%. Section 4004.1 "(a) It shall be unlawful for any person to burn trash, grass, leaves, paper, cloth, boards, planks, lumber or any other character of debris or infl_ammable material whatsoever except brush and trees out-of-doors in the City. "(b) It shall be unlawful for any person to burn brush or trees out-of-doors in the City unless such person has procured through the fire chief or his desigrlee a permit permitting such burning. "(c) Outside burning permits shall be issued by the fire chief or his designee. A fee of one hundred dollars ($100.00), shall accompany any request for burning permit, such fee shall cover the inspection of the area and the material to be burned. If a permit is issued, it will be subject to the requirements contained therein and all costs in meeting such requirements shall be borne by the person requesting the permit. The requirements may include, but are not limited to, firelanes, civilian or firemen sentry watches, burn pits, extinguishirig agents, the laying ot firehose or the presence of other fire-fighting equipment. Any requirement for fire-fighting equipment or personnel of the City will be charged to and paid for by the permittee. The fire chier or his designee sha11 consider humidity, permissible wind conditions, susceptiblity of vegetation to combustion, the proximity of residences and other structures, composition of material tc be burned, smoke, heat and duration of burn." Section 2. Any person violating any ot the provisions of this ordinance shall be guilty of a Misdemeanor, and upon conviction shall be fined in any sum not to exceed *2,000.00, and each and every day's continuance ot any violation of the above enumerated section shall constitute and be deemed a separate otfense.
