<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 90-044 <br /> <br /> AN ORDINANCE OF THE CtTY OF PARIS, PARIS, TEXAS, <br /> PROVIDING THAT THE CODE OF URDINANCES, CITY OF PARIS, BE <br /> AMENDED BY REVISING SECTIOlV 4004 UF THE STANDARD FIRE <br /> PREVENTION CODE, 1988 ADDITION INCLUDED IN SECTION 12-87 OF <br /> SAID CODE; PROVIDING THAT IT SHALL BE UNLAWFUL FOR ANY PERSON <br /> TO BURN BRUSH OR TREES OUT OF DOORS IN THE CITY LIMITS <br /> wITHOUT A PERMIT; PROVIllING FOR A PENALTY NOT TU EXCEED <br /> $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN <br /> CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF <br /> NOVEMBER l, 1990. <br /> BE IT UKDAINED BY THE CITY CUUNCIL OF THE CITY OF PARIS: <br /> <br /> Section 1. That the Code of Ordinances of the City <br /> of Paris, Paris, Texas, be amended by revising Section 12-87, <br /> to read as follows: <br /> "Sec. 12-8%. <br /> <br /> Section 4004.1 <br /> "(a) It shall be unlawful for any person <br /> to burn trash, grass, leaves, paper, cloth, <br /> boards, planks, lumber or any other character <br /> of debris or infl_ammable material whatsoever <br /> except brush and trees out-of-doors in the <br /> City. <br /> "(b) It shall be unlawful for any person <br /> to burn brush or trees out-of-doors in the <br /> City unless such person has procured through <br /> the fire chief or his desigrlee a permit <br /> permitting such burning. <br /> <br /> "(c) Outside burning permits shall be <br /> issued by the fire chief or his designee. A <br /> fee of one hundred dollars ($100.00), shall <br /> accompany any request for burning permit, such <br /> fee shall cover the inspection of the area and <br /> the material to be burned. If a permit is <br /> issued, it will be subject to the requirements <br /> contained therein and all costs in meeting <br /> such requirements shall be borne by the person <br /> requesting the permit. The requirements may <br /> include, but are not limited to, firelanes, <br /> civilian or firemen sentry watches, burn pits, <br /> extinguishirig agents, the laying ot firehose <br /> or the presence of other fire-fighting <br /> equipment. Any requirement for fire-fighting <br /> equipment or personnel of the City will be <br /> charged to and paid for by the permittee. The <br /> fire chier or his designee sha11 consider <br /> humidity, permissible wind conditions, <br /> susceptiblity of vegetation to combustion, the <br /> proximity of residences and other structures, <br /> composition of material tc be burned, smoke, <br /> heat and duration of burn." <br /> Section 2. Any person violating any ot the <br /> provisions of this ordinance shall be guilty of a <br /> Misdemeanor, and upon conviction shall be fined in any sum <br /> not to exceed *2,000.00, and each and every day's continuance <br /> ot any violation of the above enumerated section shall <br /> constitute and be deemed a separate otfense. <br />
