SAMPLE - RECONSTRUCTIC}N CONTRACT This contract is between (HOMEOWNER NAME) ,(ADDRESS) (referred to in this Contract as the "Owner") and (BUILDER NAME), (ADDRESS) (referred to in this Contract as the "Contractor") warrandng itself to be licensed and qualified to perForm the work specified herein. TFtis Contract is for the reconstruction of property located at (HOMEOWNER ADDRESS), (referred to in this Contract as the "Property"). IN CONSIDERATION OF THEIR MUTUAL PROMISES, THE PARTIES AGREE AS F4LLOWS: PART I. Specific Terms 1. THE CONTRACT: This Contract consists oniy of this Part I(Specific Terrns), Part II (Standard Terms), and the following attachments: a. Schedule of Woiic (Work write-up) b. Specifications contained in Statutory Requirements and Bid Forms Part I; Technical Construction Specifications Part II; and Construction Floor Pians for Design 1(specffications book or performance manual, as applicable); C. Payment schedule 2. TIME FOR COMMENCEMENT AND COMPLETION: The Contractor agrees to commence, or cause to be commenced, the actual work described in the Schedule of Work within ten (10) calendar days from the date of the Notice to Proceed. The Contractor agrees to complete, free of liens or rights of liens of contractors, mechanics, materialmen or Iaborers, all work iisted above within 120 days after the Effective Date of this Contract, subject to extensions approved by the Owner and the Contract Administrator for the period of any excusable delays (incfuding strikes, acts of God or other reasons beyond the control of the Owner or Contractor). The Cantracfor agrees that time is of the essence of this Contract. The Contractor agrees to pay a fixed unit price per consecutive calendar day for delays beyond the Contract date fixed for reaching "Final Completion". For failure to complete the project within the allotted time, the Contractor acknowledges, and agrees to pay liquidated damages in the amount of $ 75.00 (Seventy-frve dollars) per day for each consecutive calendar day (or portion thereofl that the project remains incomplete or unfinished until the dste the Project Administrator declares the project "Final". 3. CONTRACT PRICE: The Contractor agrees to accomplish work as described in the Schedufe of Wor1c in accordance with each and every term and condition of this Contract, for a tota) contract price of $ .
