or more for the rehabilitation, in whole or in part, of nonresidential praperty or the <br />nonresidential portion of mixed-use property, the Contractor agrees to abide by Federal <br />Labor Standards regulations. <br />8. CONDITION qF PREMISES: The Contractor agrees to keep the premises broom clean and <br />orderly and to remove all debris as needed during the course af the worC, in order to <br />maintain work conditions which do not cause health or safety hazards. <br />9. LEAD-BASED PAINT: The Contractor agrees to use na lead-based paint in the Contractor's <br />performance of work under this Contract. "Lead-based paint" means any paint containing <br />more than six one-hundredths ar one (1) per csnt fead by weight (caiculated as lead metal) <br />in the total nonvolatile content of the paint or the equivalent measure of lead in the dried <br />film of paint aiready applied. <br />10. TERMENATION: The Contractor agrees that the Owner shall have the right to declare the <br />Contractor in default if the Contractor fails to fumish materials or pertorm work in <br />accordance with the provisions of this Contract. In such event the Owner shall be <br />responsible for providing written notice to the Contractor by registered mail of such defauit. <br />if the Contractor fails to remedy such defauit within fifteen (15) days of such notice, the <br />Owner shail have the right to select one or more substitute oontractors acceptable to the <br />Contract Administrator. If the expense of finishing the worlc exceeds the balance not yet <br />paid to the Contractor on this Contract, The Contractor shall pay the difference to the <br />Owner. The Owner may use any holdback amount to compensate substitute contractors <br />selected pursuant to this paragraph, and the Contractor shall have no further right to our <br />interest in the holdback amount. <br />11. DISPUTE RESOLUTION: All claims or disputes between Ovmer and Contractor, or <br />between Owner and Contract Administrator ar between Contractor and Contract <br />Administration arising out of or related to the construction and/or rehabilitation work <br />perfomned on the HOME assisted property shall be decided by arbitration in accordance <br />with the consbruction industry arbitratian rules of the American Arbitration Associatian. The <br />homeowner, contractor andlor Contractor Administrator shaN submit all disputes or claims, <br />regardless of the extent of the worC's progress, to an arbitrator who is mutually agreed upon <br />by all parties. Notice of the demand for arbitration shall be filed in writing with the other <br />party to this agreement, and shall be made within a reasonable amount of time after the <br />dispute has arisen. The award rendered by the arbitrator shall be final, and judgment may <br />be entered upon it in acoordance with applicable law in any court having jurisdiction tfiereof. <br />12. INSPECTION: The U.S. Govemment, the Texas Department of Housing and Communiry <br />Affaits, the Contract Administrator, and their designees shall have the right to inspect al1 <br />work perFormed under this Contract. The Contractor and Owner will take all steps <br />necessary to assure that the U.S. Govemment, the state, and the Contract Administrator, or <br />their designees, are permitted to examine and inspect the Property, and atl contracts, <br />materials, equipment, payralls, and conditions of employment pertaining to their work, <br />including all relevant data and records. By such inspection, the U.S. Govemment, the State <br />af Texas, and the Confract Administrator assume no responsibility to the Owner for <br />defective material or work under this contract or to either party for any breach of this <br />Contract by the other. <br />13. FINANCIAL INTEREST OR BENEFIT: AI1 Contract Administrators are required to comply <br />with 24 CFR 92.356. The parties to this Contract agree that none of the following shall have <br />~ 269 <br />
