ORDINANCE N0. 87-041 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING ARTICLE III, CHAPTER 7 OF SAID CODE BY ADDING SECTION 7-16 AND REVISING SECTION 7-17; PROVIDING FOR I7ETAILED PLANS AND SPECIFICATIONS FOR TRENCH SAFETY SYSTEMS THAT MEET OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION STANDARDS FOR ALL CONSTRUCTION PROJECTS IN WHICH TRENCH EXCAVATION WILL EXCEED A DEP`tH OF FIVE FEET; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEAI,ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF SEPTEMBER 1, 1987. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Article III, Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended by adding Section 7-16 so that such shall read as follows: "Sec. 7-16. Section 1301.1 amended. Section 1301.1 of the building code adopted by this article is hereby amended by renumbering existing paragraph to be paragraph (a) and adding paragraph (b) to read as follows: (b) Construction projects with trench excavations exceeding a depth of five feet must incorporate a trench safety system constructed in accordance with detailed plans and specifications for the same meeting the Occupational Safety and Health Administration standards. Such detailed plans and speci- rications shall be included in the bid documents and the contract." Section 2. That Sectian 7-17 of the Code of Ordi- nances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Section 114 of the building code adopted by this article is hereby amended to read as follows: A person who shall violate a provision of this code or fails to comply therewith or with any of the requirements thereof, or who shall erect, construct, alter or repair, or has erected, constructed, altered or repaired a building or structure in violation of a detailed statement or plan submitted and approved thereunder, or of a permit or certificate issued thereunder, shall be guilty of a misdemeanor and, upon conviction therefor, shall be fined in any sum not exceeding two thousand dollars ($2,000.00), and each and every day's continuance of any violation of the provisions of this code shall constitute and be deemed a separate offense." Section 3.
