<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 86-026 <br /> <br /> <br /> AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, <br /> DECLARING A STATE OF EMERGENCY UNDER SECTION 31-28 OF THE <br /> CODF. OF ORDINANCES OF THE CITY OF PARIS; PROVIDING THAT THE <br /> CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING <br /> SECTION 31-28 OF SAID CODE; PROVIDING FOR THE EMERGENCY <br /> RATIONING OF CITY OF PARIS WATER; PROVIDING FOR A PENALTY <br /> NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF <br /> ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN <br /> EFFECTIVE DATE OF JULY 28, 1986. <br /> WHEREAS, the City Council of the City of Paris did meet <br /> at a Special Meeting on the 28th day of July, 1986 and <br /> considered an emergency item for rationing of water due to <br /> the City of Paris Water Department's inability to meet the <br /> unrestricted needs of its water customers; and, <br /> WHEREAS, it is found that the Water Department cannot <br /> meet the unrestricted demands of its customers and therefore <br /> an emergency exists; and, <br /> WHEREAS, emergency measures must be taken to insure <br /> that the citizens of Paris are afforded fire protection; <br /> NOW, THEREFORE, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> <br /> Section 1. That a state of emergency uiider Section <br /> 31-28 of the Code of Ordinances of the City of Paris is <br /> hereby declared. <br /> Section 2. That the Code of Ordinances of the City <br /> of Paris, Paris, Texas, be amended by revising Section <br /> 31-28, to read as follows: <br /> "Sec. 31-28. Fmergency rationing of water. <br /> <br /> The City Council may upon finding that the <br /> Water Department of the City of Paris is approach- <br /> ing the condition of not being able to meet the <br /> demands of its customers, authorize the Mayor of <br /> the City of Paris to declare a state of emergency <br /> when the Water Department of the City cannot meet <br /> the demands of its customers and afford fire <br /> protection to the City of Paris. When such an <br /> emergency has been declared, it shall be unlawful <br /> for any water customer to make outside use of city <br /> water for such period of time as the Mayor may <br /> set, and thereafter it shall be unlawful for any <br /> water customer with an even address number to make <br /> outside use oi city water on odd numbered days of <br /> the month and for dny water customer with an odd <br /> address number to make outside use of city water <br /> on even numbered days of the month, except all <br /> customers are permitted to make outside use of <br /> city water for the period beginning at 7:00 <br /> o'clock A.M. Sunday and ending 7:00 o'clock A.M. <br /> Monday, until such time as the Mayor declares the <br /> state of emergency to cease." <br /> Section 3. Any person violating any of the pro- <br /> visions of this ordinance shall be guilty of a Class "C" <br /> Misdemeanor, and upon conviction shall be fined in any sum <br /> not to exceed $200.00, and each and every day's continuance <br /> of any violation of the above enumerated section shall <br /> constitute and be deemed a separate offense. <br />
