<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 85-018 <br /> <br /> AN ORDINANCE ESTABLISHING TERMS AND CONDITIONS UNDER <br /> WHICH THE CITY OF PARIS WILL RECEIVE INDUSTRIAL WASTE OF <br /> UNUSUAL STRENGTH AND CHARACTER FROM MERICO, INC., OBLIGATING <br /> THE CITY TO MAKE IP'IPROVEMENTS TO ITS WASTE WATER TREATMENT <br /> PLANT, AUTHORIZING THE EXPErdDITURE OF FUNDS CONTRIBUTED BY <br /> MERICO, INC. AND CITY FUNDS, AT1D AUTHORIZING THE EXECUTION <br /> OF A CONTR.ACT CONCERNING THE SAME; REPEALING ALL ORDINANCES <br /> OR PARTS OF ORDINANCES IN CONFLICT HEREWITH APdD PROVIDING <br /> FOR AN EFFECTIVE DATE OF APRIL 15, 1985. <br /> WHEREAS, Merico, Inc., a Texas Corporation and corpo- <br /> rate citizen of the City of Paris is a customer of the City <br /> of Paris' sewer system; and <br /> WHEREAS, Merico, Inc., is a Significant Industrial User <br /> of the City of Paris' POTW and is eligible to request the <br /> handling and trea.ting of industrial waste of unusual <br /> strength and character, under the provisions of Section <br /> 31.86 of the Cade of Ordinances of the City of Paris, upon <br /> such contractual terms as may be established by the City <br /> Council of the City of Paris; and, <br /> WHEREAS, the City of Paris is a homerule city whose <br /> Charter was approved by election held on November 2, 1948, <br /> and validated by Section 1174a-1 of the Vernon's Texas Civil <br /> Statutes, is authorized under Article 1175, paragraph 13, <br /> Vernon's Texas Civil Statutes to own and operate sewerage <br /> plants; and under paragraph 14 of Article 1175 is authorized <br /> to sell arything needed or used by the public upon such <br /> terms as may be provided by its Charter; and, <br /> WHEREAS, Section 5 of Article II of the Charter of the <br /> City of Paris authorizes the establishment of rates by <br /> Ordinance and authorizes the City to contract and be con- <br /> tracted with; and, <br /> WHEREAS, the City of Paris and Merico, Inc., have <br /> reached an agreement mutually beneficial to the City of <br /> Paris and Merico, Inc.; and, <br /> WHEREAS, it is deemed to be in the best interest of the <br /> citizens of Paris that such agreement in the form of Exhibit <br /> A attached hereto and made a part hereof, be in all things <br /> approved; NOW THERFFORE, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> <br /> Section 1. That the form of contract between the City <br /> of Paris and Merico, Inc., attached hereto as Exhibit A, <br /> establishing terms and conditions under which the City of <br /> Paris will receive industrial waste of unusual strength and <br /> character from Merico, Inc., obligating the City to make <br /> improvements to its waste water treatment plant, and <br /> authorizing the eypenditure of funds contributed by Merico, <br /> Inc., and City funds, is in all things approved. <br /> Section 2. That the Mayor of the City of Paris, Joe <br /> Graham, be, and he is hereby authorized and directed to <br /> execute on behalf of the City of Paris, the contract for <br /> handling and treating industrial waste of unusual strength <br /> and character with Merico, Inc. in the form of Exhibit A <br /> attached hereto. <br /> Section 3. Al1 ordinances or parts of ordinances in <br /> conflict herewith are hereby expressly repealed. <br /> <br /> <br /> <br /> 71, V <br />
