<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. $4-013 <br /> <br /> <br /> AN ORDITdANCE OF THE CITY OF PAF.IS, PARIS, TEXAS, <br /> PROVIDII1G THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE <br /> AMENDED BY REVISING SUB-PARAGRAPH (A) OF SECTION 16-18 OF <br /> SAID CODE; PP.OVIDING FOR THE CLASS OF PERSONS TO RECEIVE <br /> NOTICE OF PdUISANCE JUNKED VEHICLES; PROVIDING FOR A PFNALTY <br /> NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF <br /> ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN <br /> EFFECTiVE DATE OF 14ARCH 1, 1984. <br /> BE IT ORDAIPdED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> Section 1. That sub-paragraph (a) Section 16-18 of <br /> the Code of Ordinances of the City of Paris, Paris, Texas, <br /> be amended so that such shall read as follows: <br /> <br /> "Sec. 16-18. Abatement or removal order; <br /> contents, service. <br /> (a) Whenever any such public nuisance exists <br /> in the city in violation hereof, the chief of <br /> police, or his duly authorized agent who shall <br /> administer this article, shall send written <br /> notice, by certi£ied r.lail with a 5-day return <br /> requested, to the last known registered owner of <br /> the motor vehicle and all lien holders of record <br /> and to the owner or occupant of the public prem- <br /> ises or to the owner or occupant of the premises <br /> adjacent to the public right-of-way on which the <br /> public nuisance exists. Said notice shall specify <br /> the nature of the public nuisance; specify that it <br /> r.iust be removed and abated within ten (10) days <br /> after the delivery date of the certified mail <br /> receipt of such notice; a.nd specify that a request <br /> for a public hearing under section 16-18 (b) <br /> hereof must be r.zade before expiration of said ten <br /> (10) day period. If the notice is returned <br /> ur_delivered by the United States Post Office, <br /> official action by the City of Paris to abate said <br /> nuisance shall be continued to a date not less <br /> than ten (10) days from the date of such return." <br /> Section 2. Any person violating any of the pro- <br /> visions of this ordinar_ce shall be guilty of a Class "C" <br /> Misdemeanor, and upon conviction shall be fined in any sum <br /> not to exceed $200.00, and each and every day's continuan.ce <br /> ef a.ny violation of the above enumerated section shall <br /> constitute and be deenned a separate offense. <br /> Section 3. All ordinances or parts of ordinances in <br /> conflict herewith are hereby expressly repealed. <br /> Section 4. This ordinance shall become effective on <br /> March 1, 1984. <br />
