<br /> AN ORDINANCE APPROVING RATE SCHEDULES TO BE CHARGED BY
<br /> TEXAS UTILITIES ELECTRIC COMPANY IN THE CITY OF PARIS,
<br /> PARIS, TEXAS, PROVIDING FOR SCHEDULES, EFFECTIVE DATE,
<br /> CONDITIONS, SEVERABILITY, REPEAL OF CONFLICTING ORDINANCES.

<br /> WHEREAS, on March 9, 1984, Texas Utilities Electric
<br /> Company (TUEC) filed with the City of Paris, Paris, Texas a
<br /> request for an increase in electric utility rates to be
<br /> charged within the City in the amount of approximately
<br /> $304.2 million per annum plus an increase in fuel expense
<br /> included in rates in the amount of $157.9 million per annuM
<br /> on a system-wide basis; and,
<br /> WHEREAS, the City, having suspended the effective date
<br /> of such proposed increase from April 13, 1984, and having
<br /> considered the same at a public hearing, is of the opinion
<br /> and finds that the rates of TUEC should be adjusted; NOW,
<br /> THEREFORE,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br /> PARIS; as follows:
<br /> l. That the rates, tariffs, and charges of TUEC for
<br /> electric power and energy sold within the City be adjusted
<br /> in an amount such that the adjusted total system-wide
<br /> operating revenues for the Company be decreased $30,806,000,
<br /> such decrease consi_sting of an increase of $32,191,000 per
<br /> annum in non-fuel expense included in rates and a decrease
<br /> of $62,997,000 per annum in fuel expense included in rates.
<br /> Such Schedules of Rates, as are approved in accordance
<br /> herewith, are those under which said Company shall be
<br /> authorized to render electric service and to collect charges
<br /> form its customers for the sale of electric power and energy
<br /> within the corporate limits of the City of Paris, Texas
<br /> until such time as said Rate Schedules may be changed,
<br /> modified, amended, or withdrawn, with the approval of the
<br /> City Council.
<br /> 2. That TUEC shall file with the city a revised
<br /> Schedule of Rates and Tariffs setting forth those rates,
<br /> tariffs, and charges based upon such decrease in total
<br /> operating revenues as prescribed herein. Such Schedule of
<br /> Rates and Tariffs may be modified or amended by the City
<br /> Council within ten (10) days from the date of filing with
<br /> the city, otherwise the same shall be considered approved as
<br /> filed. Such Schedule of Rates and Tariffs, as the same may
<br /> be modified or amended, shall not become effective prior to
<br /> the date upon which rates for customers of TUEC within
<br /> unincorporated areas are allowed to go into effect by the
<br /> Public Utility Commission of Texas in Docket 5640 now
<br /> pending before such Commission and shall not, in any case,
<br /> exceed those rates set in such Docket 5640 for customers of
<br /> TUEC in unincorporated areas.
<br /> 3. That the action of the City Council of the City of
<br /> Paris enacting this Ordinance constitutes, on the date of
<br /> its final passage, a final determination of rates for TUEC
<br /> within the City of Paris, Paris, Texas in accordance with
<br /> Section 43 (e) of the Public Utility Regulatory Act.
<br /> 4. Nothing in this Ordinance contained shall be
<br /> construed now or hereafter as limiting or modifying, in any
<br /> manner, the right and power of the City of Paris under the
<br /> law to regulate the rates and charges of TUEC.
