ORDINANCE N0. $4-058 AN ORDINAr1CE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING SECTION 27-97 AND SECTION 27-99 OF SAID CODE; PROVIDING THAT THE MINIMUM CLEARANCE OF OVERHANG OVER SIDEWALK AREA BE INCREASED FROM EIGHT (8) FEET TO TEN (10) FEET AND THE MINIMUM CLEARANCE OF OVERHANG OVER STREET AREA BE INCREASED FROM EIGHT (8) FEET TO TEN (10) FEET AT CURB LINE AND FROM TWELVE (12) FEET TO (15) FIFTEEN FEET AT THE CENTER OF THE STREET; PkOVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR. AN EFFECTIVE DATE OF SEPTEMBER l, 1984. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section l. That Section 27-97 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 27-97. Minimum Height of Tree Limbs Over Sidewalk Area. It shall be unlawful for the owner or occu- pant of any property in the city, or his agents, servants or employees, to maintain or permit limbs of trees growing thereon to overhang or grow about the sidewalk area abutting such property, unless such limbs and all branches and foliage thereon are kept trimmed and pruned to a minimum clearance height of ten (10) feet above the street level at the nearest curbline." Section 2. That Section 27-99 of the Code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Sec. 27-99. Removal of trees and plants growing between opposite curblines; trimming limbs overhanging such area. The city manager is hereby authorized to remove or cause to be removed any trees, limbs or plants found between the opposite curblines in any street in the city and to trim branches, limbs or foliage of any tree or plant which overhangs or grows above the area which lies between the opposite cur.blines of any street, so as to provide a minimum clearance of ten (10) feet above the street level at the curbline and so as to be graduated toward the center of the street to a clearance of fifteen (15) feet above the street level at the center of the street." Section 3. Any person violating any of the pro- visions of this ordir.ance shall be guilty of a Class "C" Misdemeanor, and upon conviction shall be fined in any sum not to exceed $200.00, and each and every day's continuance of any violation of the above enumerated section shall constitute and be deemed a separate offense. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed.
