CALCULATION OF SHORTENED CAPACITY LIFE <br /> SURCHARGE <br /> <br /> A= Average monthly monthly measured BODS at wastewater plant <br /> (lbs. per day) <br /> B= BOD in pounds at wastewater plant if received at <br /> predetermined normal domestic wastewater strength. <br /> <br /> C= Design life of wastewater plant (month). <br /> <br /> E= Adjusted capacity life (months) <br /> F= Construction cost for treatment plant. <br /> <br /> G= Amount in dollars to be distributed over excessive strength <br /> industry for any given month. <br /> <br /> H= Industry BOD5 contribution in excess of normal domestic <br /> wastewater (lbs). <br /> I= Shortened capacity life surcharge. <br /> <br /> E= B (C) <br /> A <br /> <br /> G= F i( l+i ) E -F C <br /> (1+i)E-1 (l+i) C -1 <br /> I= (G) ~c H <br /> <br /> Shortened capacity life surcliarge shall be calculated monthly. <br /> 7. TOTAL SURCHARGES <br /> <br /> a. Total surcharge shall be the sum of the excessive strength <br /> surcharge plus the shortened capacity life surcharge. <br /> b. Excessive strength surcharge rates will be recalculated at <br /> the beginning of each fiscal year using the actual costs <br /> from the previous year with such rate becoming effective <br /> September 1. Excessive strength surcharge rates shall be <br /> based on cost to treat. <br /> G. LEGAL ACTIUN <br /> <br /> If any person discharges industrial or other wastes or sewage <br /> into the City's wastewater facilities contrary to the provisions of this <br /> ordinance, federal or state pretreatment requirements, or ariy order <br /> of the City, the City Attorney may commence an action for <br /> appropriate legal and/or equitable relief in a court of competent <br /> jurisdiction. The City may recover reasonable attorney's fees, court <br /> costs, court reporter's fees and other expenses of litigation. <br /> H. CIVIL PENALTIES <br /> Any user who is found to have violated an order of the City <br /> Council or who willfully or negligently failed to comply with any <br /> provision of this ordinance, and the orders, rules, regulations and <br /> permits issued hereunder, shall be fined not less than one hundred <br /> dollars ($100) nor more than two hundred dollars ($200) for each <br /> offense. Each day on which a violation occurs or continues shall be <br /> deemed a separate and distinct offense.
