TOTAL SURCHARGES <br /> <br /> a. Total surcharge shall be the sum of the excessive <br /> strength surcharge plus the shortened capacity <br /> life surcharge. <br /> b. Excessive strength surcharge rates will be <br /> recalculated at the beginning of each fiscal year <br /> using the actual costs from the previous year <br /> with such rate becoming effective September 1. <br /> Excessive strength surcharge rates shall be based <br /> on cost to treat. <br /> G. LEGAL ACTION <br /> If any person discharges industrial or other wastes or <br /> sewage into the City's wastewater facilities contrary to the <br /> provisions of this ordinance, federal or state pretreatment <br /> requirements, or any order of the City, the City Attorney <br /> may commence an action for appropriate legal and/or <br /> equitable relief in a court of competent jurisdiction. The <br /> City may recover reasonable attorney's fees, court costs, <br /> court reporter's fees and other expenses of litigation. <br /> <br /> <br /> <br /> <br /> 31 <br />
