OkDINANCE N0. 83-057 AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF PAP.IS, BE AMENDED BY REVISING SECTION 28-11 AND SECTION 28-12 OF SAID CODE; PRQVIDING THAT THE HOTEL OCCUPANCY TAX BE INCREASED TO FIVE (5) PERCEPdT AND THAT THE USE OF REVENUE DERIVED FROM SAME BE EXPANDED IP1 ACCORDANCE WITH STATE LAW; PROVIDING FOR A PENALTY NOT TO EXCEED $200.00; REPEALING ALL ORDINANCES OR PARTS OR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF OCTGBER 1, 1983. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. That Sect.ion 28-11 of the Code ot Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Section 28-11. Tax Levied. (a) There is hereby imposed and levied a tax upon the occupant ot any room or space furnished by any hotel where the cost ot occupancy is at the rate of two dollars ($2.00) or more per day, such tax to be equal to five (5) percent of the consideration paid by any such occupant of any such room or space i.n any such hotel, exclusive of other occupancy taxes imposed by other units of government. (b) A portion of the Tax revenue derived from the levy herein equal to at least one (1) percent of the cost of the occupancy of hotel rooms, shall be used for the purpose of advertising and conducting solicitation programs to acquaint potentiai users with public meetings and convention facilities, and for promotion of tourism and advertising of the City and its vicinity either by the City or through contract with persons or organizations selected by the City. (c) All ot the tax revenue derived trom the levy herein in excess of four (4%) percent may only be used for the purposes enumerated in sub-paragraphs (a) (b) and (c) of Section 28-12 ot the Code of Ordinances ot the City of Paris. (d) No more than one (1%) percent of the consid- eration paid by an occupant of an hotel or motel room may be spent on the arts as authorized by sub-paragraph (d) of Sectior. 28-12 of the Code ot Ordinances of the City of Paris." Section 2. That sub-paragraph (e) of Section 28-12 of the code of Ordinances of the City of Paris, Paris, Texas, be amended so that such shall read as follows: "Section 28-12. Use of revenue limited. (e) historical preservation ar.d restoration projects or activiti.es at or in the immediate vicinity of convention center facilities or historical pre- servation and restoration projects or activities located elsewhere in. the (;ity that would be frequented by tourist or visitors to the City."
