ORDINANCE N0. 83-060 AN ORDINANCE PROVIDING FOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM BY THE PARIS-LAMAR COUNTY HEALTH UNIT ACTING AS THE HEALTH DEPARTMENT OF THE CITY OF PARIS, PARIS, TEXAS AND PROVIUING FOR AN EFFECTIVE DATE OF OCTOBER 1, 1983. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: Section 1. The City Council of the City of Paris, Paris, Texas, on behalf of said City, hereby exercises its option and elects to have the employees of the Paris-Lamar County Health Unit which acts as the Health Department for the City of Paris who are not employees of the State of Texas and all departments now existing and those hereafter created, except those employeed of the Fire Department who are included in or who are eligible to be included in membership in Firemen's Relief and Retirement Fund of the City of Paris, participate in the Texas Municipal Retirement System as provided in the TMRS Act. Section 2. The Mayor is hereby authorized and directed to notify the board of Trustees of the Texas Municipal Retirement System that the City has elected to include the employees of the Paris-Lamar County Health Unit which acts as the Health Department for the City of Paris who are not employees of the State of Texas in participation and have said employees covered in said System. Section 3. Each person less than 60 years of age or who was less than 60 years of age when that person becar_ie an employee of the Paris-Lamar County Health Unit, acting as the Health Department of the City of Paris, who is not an employee of the State of Texas, who becomes an employee of any participating department on or after the effective date of participation of such department shall become a member of the Texas Municipal Retir-ement System as a condition of his or her employment. Section 4. In accordance with the provisions of the TMRS Act, the deposits to be made to the Texas Municipal Retirement System on account of current service of the employees of the several participating departments are hereby f ixed at the rate of f ive percent (5%) of the full earnings of each employee of said departments. Section 5. Each employee who qualifies for such credit shall be allowed "prior service credit" (as defined in Section 63.101 of the TMRS Act) at the rate of one hundred percent (100%) of the "base credit" of such member, calculated in the manner prescribed in Section 63.105 of said Act. Section 6. For each month of current service rendered to this Paris-Lamar County Health Unit acting as the City of Paris Health Department by each of its employees who are members of Texas Municipal Retirement System, the City will contribute to the current service annuity reserve of each such member at the time of his or her retirement, a sum that of 150% of such member's accumulated deposits for such month of employment; and said sum shall be contributed from the City's account in the municipality accumulation fund. Section 7. The Director of Finance is hereby directed to remit to the Board of Trustees of the Texas
