<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE N0. 83-060 <br /> <br /> AN ORDINANCE PROVIDING FOR PARTICIPATION IN THE TEXAS <br /> MUNICIPAL RETIREMENT SYSTEM BY THE PARIS-LAMAR COUNTY HEALTH <br /> UNIT ACTING AS THE HEALTH DEPARTMENT OF THE CITY OF PARIS, <br /> PARIS, TEXAS AND PROVIUING FOR AN EFFECTIVE DATE OF <br /> OCTOBER 1, 1983. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> PARIS: <br /> Section 1. The City Council of the City of Paris, <br /> Paris, Texas, on behalf of said City, hereby exercises its <br /> option and elects to have the employees of the Paris-Lamar <br /> County Health Unit which acts as the Health Department for <br /> the City of Paris who are not employees of the State of <br /> Texas and all departments now existing and those hereafter <br /> created, except those employeed of the Fire Department who <br /> are included in or who are eligible to be included in <br /> membership in Firemen's Relief and Retirement Fund of the <br /> City of Paris, participate in the Texas Municipal Retirement <br /> System as provided in the TMRS Act. <br /> Section 2. The Mayor is hereby authorized and <br /> directed to notify the board of Trustees of the Texas <br /> Municipal Retirement System that the City has elected to <br /> include the employees of the Paris-Lamar County Health Unit <br /> which acts as the Health Department for the City of Paris <br /> who are not employees of the State of Texas in participation <br /> and have said employees covered in said System. <br /> Section 3. Each person less than 60 years of age or <br /> who was less than 60 years of age when that person becar_ie an <br /> employee of the Paris-Lamar County Health Unit, acting as <br /> the Health Department of the City of Paris, who is not an <br /> employee of the State of Texas, who becomes an employee of <br /> any participating department on or after the effective date <br /> of participation of such department shall become a member of <br /> the Texas Municipal Retir-ement System as a condition of his <br /> or her employment. <br /> Section 4. In accordance with the provisions of the <br /> TMRS Act, the deposits to be made to the Texas Municipal <br /> Retirement System on account of current service of the <br /> employees of the several participating departments are <br /> hereby f ixed at the rate of f ive percent (5%) of the full <br /> earnings of each employee of said departments. <br /> Section 5. Each employee who qualifies for such <br /> credit shall be allowed "prior service credit" (as defined <br /> in Section 63.101 of the TMRS Act) at the rate of one <br /> hundred percent (100%) of the "base credit" of such member, <br /> calculated in the manner prescribed in Section 63.105 of <br /> said Act. <br /> Section 6. For each month of current service <br /> rendered to this Paris-Lamar County Health Unit acting as <br /> the City of Paris Health Department by each of its employees <br /> who are members of Texas Municipal Retirement System, the <br /> City will contribute to the current service annuity reserve <br /> of each such member at the time of his or her retirement, a <br /> sum that of 150% of such member's accumulated deposits for <br /> such month of employment; and said sum shall be contributed <br /> from the City's account in the municipality accumulation <br /> fund. <br /> Section 7. The Director of Finance is hereby <br /> directed to remit to the Board of Trustees of the Texas <br />
