<br />AN ORDINANCE SETTING A DATE, TIME AND PLACE FOR
<br />PUBLIC HEARINGS BEFORE THE PLANNING AND ZONING
<br />COMMISSION OF THE CITY OF PARIS AND THE CITY COUNCIL
<br />OF THE CITY OF PARIS ON THE PROPOSED ANNEXATION OF
<br />CERTAIN PROPERTY BY THE CITY OF PARIS, PARIS, TEXAS, AND
<br />APPROPRIATE ZONING LTONR TO ANNEXATION, NOTICE OF AUTHORIZING
<br />PUB-
<br />AND DIRECTING THE MAYO
<br />LIC HEARINGS.
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />PARIS:
<br />Section l. That public hearings be held by and before the
<br />Planning and Zoning Commission of the City of Paris, Paris, Texas,
<br />on the 4th day of April, 1977, at 7:00 o'clock P. M. , in the Council
<br />Room, City Hall, Paris, Texas, and by and before the City Council
<br />of the City of Paris, Paris, Texas, on the llth day of April, 1977,
<br />at 7:00 o'clock P. M. , in the Council Room, City Hall, Paris, Texas,
<br />giving all interested persons the right to appear and be heard on
<br />the proposed annexation and appropriate zoning upon annexation of
<br />the property described on Exhibit A attached hereto.
<br />Section 2. That the Mayor of the City of Paris, Paris, Texas,
<br />is hereby authorized and directed to cause notice of such public
<br />hearings to be published once in the newspaper having general circu-
<br />lation in the City and in the above described territory not more than
<br />twenty (20) days nor less than ten (10) days prior to the date of such
<br />public hearings, all in accordance with the Municipal Annexation Act
<br />(Chapter 160, Acts of the 58th Legislature, Regular Session, 1963;
<br />compiled as Article 970a, Vernon's Texas Civil Statutes).
<br />Section 3. It is hereby declared to be the intention of the City
<br />Council of the City of Paris that the sections, paragraphs, sentences,
<br />clauses and phrases of this ordinance are severable, and if any
<br />phrase, clause, sentence, paragraph or section of this ordinance
<br />shall be declared unconstitutional or invalid by the valid judgment or
<br />decree of any court of competent jurisdiction, such unconstitutionality
<br />or invalidity shall not affect any of the remaining phrases, clauses,
<br />sentences, paragraphs and sections of this ordinance, since the
<br />same would have been enacted by the City Council without the incor-
<br />poration in this ordinance of any unconstitutional or invalid phrases,
<br />clauses, sentences, paragraphs or sections. It is further hereby
<br />declared to be the intention of the City Council of the City of Paris to
<br />exclude any area or areas described in the description of the property
<br />to be annexed, which are not within said City's jurisdiction to annex
<br />and that such area or areas should be carved out of the description
<br />of the property herein described by the valid judgment or decree of
<br />any court of competent jurisdiction, in order that such area or areas
<br />would not cause this annexation ordinance to be found to be invalid,
<br />voidable or void.
<br />Section 4. This ordinance shall take effect immediately upon
<br />passage.
