The insurers providing the propcrty insur- <br />ance sha(I consent by endorsemcnt on the policy or policies, <br />but the property insurance shall not be cancelled or lapse on <br />account of any such partial use or occupancy. <br />ARTICLE 6-CONTRACTOR'S RESPONSIBILITIES <br />Supervision and Superin[errdence: <br />6.1. CONTRACTOR shall supervise and direct the Work <br />competently and efficiently, devoting such attention thereto <br />and applying such skills and expertise as may be necessary <br />to perform the Work in accordance with the Contract Doc- <br />uments. CONTRACTOR shall be solely responsible for the <br />means, methods, techniques, sequences and procedures of <br />construction, but CONTRACTOR shall not be responsible <br />for the negligence of others in the design or selection of a <br />specific means, method, technique, sequence or procedure <br />of construction which is indicated in and required by the <br />Contract Documents. CONTRACTOR shall be responsible <br />to see that the finished Work complies accurately with the <br />Contract Documents. <br />6.2. CONTRACTOR shall keep on the Work at all times <br />during its progress a competent resident superintendent, who <br />shall not be replaced without written notice to OWNER and <br />ENGINEER except under extraordinary circumstances. The <br />superintendcnt will be CONTRACfOR's representative at . <br />the site and shall have authority to act on behalf of CON- <br />TRAC'TOR. Al[ communications given to the superintendent <br />shall be as binding as if given to CONTRACTOR. <br />Labor, Malerials aRd Equipmenl: <br />* 63. CONTRACTOR shall provide competent, suitably <br />qualified personnel to survey and lay out the Work and per- <br />form construction as required by the Contract Documents. <br />CONTRACTOR shall at all times maintain good discipline <br />and order at the site. Except in connection with the safety or <br />protection of pcrsons or the Work or property at the site or <br />adjacent thereto, and except as othecwise indicated in the <br />Contract Documents, all Work at the site shall be performed <br />during regular wocicing hours, and CONTRACTOR will not <br />permit overtime work or the pecformance of Work on Sat- <br />urday. Sunday or any Icgal hotiday without OWNER's writ- <br />ten consent given after prior written notice to ENGINEER. <br />6.4. Unless othenvise specified ia thc Generai Require- <br />ments, CONTRACTOR shall furnish and assume full respon- <br />sibility for alt materials, equipment. labor, transportation. <br />construction equipment and machinery, tools, appliances, <br />fuel, power, light. heat, telephone, water, sanitary facilities, <br />temporary facilitics and all other facitities and incidentals <br />necessary for thc furnishing, perfocmancc, testing, start-up <br />and completion of the Work. <br />6.5. All matcrials and cquipment shall be of Food quality <br />and nc~%•, cxccpt as othcnvise providcd in thc Concract Doc- <br />umcnts. lf rcquircd by ENGINEER, CONTRACTL: 2 shall <br />furnish satisfactory evidence (including reports of required <br />tcsts) as to thc kind and quality of materials and equipmeni. <br />All materials and equipment shall be applied, instat(ed, con- <br />nected, erected, used, cleaned and conditioned in accordance <br />with the instructions of the applicable Supplier except as <br />othenvise provided in the Contract Documents; but no pro- <br />vision of any such instructions wi11 be effective to assign to <br />ENGINEER, or any of ENGINEER's consultants, agents or <br />employees, any duty or authority to supervise or direct the <br />furnishing or performance of the Work or any duty or author- <br />ity to undeRake responsibility contrary to the provisions of <br />pangraph 9.15 or 9.16. <br />Adjusting Progress Sehedule: <br />6.6. CONTRACTOR shall submit to ENGINEER for <br />acceptance (to the extent indicated in paragraph 2.9) adjust- <br />ments in the progress schedule to reflect the impact thereon <br />of new devclopments; these will conform generally to the <br />progress schedule then in effect and additionally will comply <br />with any provisions of the General Requirements applicable <br />thereto. Substilules or "Or-Equa1" Ilems: <br />6.7.1. Whenever materials or equipment are specified <br />ordescribed in the Contract Documents by using the name <br />of a proprietary item or the name of a particular Supplier <br />the namiog of the item is intended to establish the type, <br />function and quality required. Unless the name is foltowed <br />by words indicating that no substitution is permitted, <br />materials or equipment of other Suppliers may be accepted <br />by ENGINEER if sufficient information is submitted by <br />CONTRACTOR to atlow ENGINEER to determine that <br />the material or equipment proposed is equivalent or equal <br />to that named.lfie procedure for review by ENGINEER <br />will include the following as supplemented in the Geaeral <br />Requirements. Requests for review of substitute items of <br />material and equipment will not be accepted by ENGI- <br />NEER from anyone other than CONTRACTOR. If CON- <br />TRACTOR wishes to furnish or use a substitute item of <br />material or equipment, CONTRACTOR shall make writ- <br />ten application to ENGINEER for acceptance thereof, <br />certifying that the proposed substitute will perform ade- <br />quately the functions and achieve the results cailed for by <br />the general design, be similar and of equal substance to <br />that specified and be suited to the same use as that spec- <br />i6ed. The application will state that the evaluation and <br />acceptance of the proposed substitute will no[ prejudice <br />CONTRACI'OR's achievement of Substantial Comple- <br />tion on time, whether or not acceptance of the substitute <br />for use in the Work will require a change in any of the <br />Contract Documents (or in the provisions of any other <br />direct contract with OWNER foc work on the Project) to <br />adapt the design to the proposed substitute and whether <br />oc not incorporation or use of the substitute in connection <br />with the Wock is subject to payment of any license fee or <br />*See Supplementax'y Conditions 42 <br />
