CONTRACTOR shall be responsible for initi:tting, <br />maintaining and supervisinc all saCety precautions and pro- <br />Frams in conncction with the Work. CONTRACTOR shall <br />take all necessary pcecautions for the saCety o(, and shall <br />pcovide the necessary protection to prevent damage, injury <br />or loss to: <br />6.20.1. all employees on the Work and othcr persons <br />and organizations who may be affected thereby: <br />6.20.2. all the Work and materials and equipment to <br />be incorporated therein, whether in storage on or oCf the <br />site; and <br />6.203. other property at the site or adjacent thereto, <br />including trees, shrubs, lawns, walks, pavements, road- <br />ways, structures, utilities and Underground Facilities not <br />designated for removal, relocation or reptacement in the <br />course of construction. <br />CONTRACTOR shall comply with all applicable Laws and <br />Regulations of any public body having jurisdiction for the <br />safety of persons or property or to protect them from damage, <br />injury or loss; and shatl erect and maintain alt necessary <br />safeguards for such safety and protection. CONTRACTOR <br />shatl notify owners of adjacent pcoperty and of Underground <br />Facilities and utility owners when prosecution of the Work <br />may affect them, and shall cooperate with them in the pco- <br />tection. removal, relocation and replacement of their prop- <br />eRy. All damage, injury or loss to any property referred to <br />in paragraph 6.20.2 or 6.203 caused, directly or indirect(y. <br />in whole or in part, by CONTRACTOR, any Subcontcactor. <br />Supptier or any other person or organization directly or indi- <br />rectly employed by any of them to perf'orm or furnish any of <br />the Work oranyone forwhose acts any of them may be liable, <br />shall be remedied by CONTRACI'OR (except damage or loss <br />attributabte to the fault of Drawings or Specifications or to <br />the acts or omissions of OWNER or ENGINEER or anyone <br />employed by either of them or anyone for whose acts either <br />of them may be liable, and not attributable, directly or indi- <br />rectly. in whole or in part, to the fault or negligence of CON- <br />TRACI'OR). CONTRACI'OR's duties and responsibilities <br />Cor the safety and protection oCthe Work shall continue until <br />such time as all the Work is completed and ENG[NEER has <br />issued a notice to OWNER and CONTRACTOR in accord- <br />ance with paragraph 14.13 that the Work is acceptable (except <br />as otherwise ezpressly provided in connection with Substan- <br />tial Completion). <br />6.21. CONTRACTOR shall designate a responsible rep- <br />resentative at the site whose duty shall be the prevention oC <br />accidents. This person shall be CONTRACTOR's superin- <br />tendenc unless otherwise dcsignated in writing by CON- <br />TRACTOR to OWNER. <br />*See Supplementary Conditions <br />rnergrircics: <br />6.22. If ENGI- <br />NEER detcrmincs that a chancc in the Contract Documents <br />is required because of the action taken in response to an <br />emergency, a\York Directive Change or Change Order will <br />be issucd to document the consequences of the changes or <br />variations. <br />Shop Drawiags and Samples: <br />6.23. After checking and verifying all field measurements <br />and after comptying with appticable procedures specified in <br />the General Requirements. CONTRACTOR shall submit to <br />ENGINEER for review and approval in accordance with the <br />accepted schedule of Shop Drawing submissions (see para- <br />graph 2.9), or for other appropriate action if so indicated in <br />the Supplementary Conditions, five copies (unless othenvise <br />specified in the General Requirements) of all Shop Drawings, <br />which will bear a stamp or specific written indication that <br />CONTRACTOR has satisfied CONTRACTOR's responsi- <br />bilities under the Contract Documents with respect to the <br />review of the submission. All submissions witl be identified <br />as ENGINEER may require. The data shown on the Shop <br />Drawings will be complete with respect to quantities, dimen- <br />sions, specified pec-formance and design criteria,• materials <br />and similar data to enable ENGINEER to review the infor- <br />mation as required. <br />6.24. CONT'RACTOR shall also submit to ENGINEER <br />for review and approval with such promptness as to cause <br />no delay in Work, a(t samples required by the Contract Doc- <br />uments. All samptes will have been checked by and accom- <br />panied by a specific written indication that CONTRACTOR <br />has satisfied CONTRACI'OR's responsibilities under the <br />Contract Documents with respect to the review of the sub- <br />mission and will be identified clearly as to material, Supplier, <br />pertinent data such as catalog numbers and the use far which <br />intended. 6.25.1. Before submission of each Shop Drawing or <br />sampte CONTRACTOR shall have determined and veri-,' <br />fied all quantities, dimensioas, specified performance cri- <br />teria, installation requirements, materials, catalog num- <br />bers and similar data with cespect thereto and reviewed <br />or coordinated each Shop Drawing or sample with other <br />Shop Drawings and samples and with thc requirements of <br />the Work and the Contract Documents. <br />,6.25.2. ' At the time of each submission. CONT'RAC- <br />TOR shall give ENGINEER specific written notice oCeach <br />variation that thc Shop Drawings or samples may have <br />from thc requirements of thc Contract Documcnts. and, <br />in additioo. shall cause a spccific ootation to bc made on <br />45 <br />
