IC any part of CONTRACTOR's «'ork depends for <br />proper execution or results upon thc work of any such other <br />contractor or utility owner (or OWNER), CONTRAC'TOR <br />shall inspcct and promptty ccport to ENGINEER in writing <br />any delays, defects or deficiencies in such work that render <br />it unavailable or unsuitable for such proper execution and <br />results. CONTRACTOR's failure so to report will constitute <br />an acceptance of thc other work as fit and proper for integra- <br />tion with CONTRACTOR's Work except for tatent or non- <br />apparent de[ects and deficicncies ia the other wori:. <br />Coordinalion: <br />7.4. If OWNER contracts with others for the perCor- <br />mance of othec work on the Project at the site, the pecson or <br />organization who will have authority and responsibiiity for <br />coordination of the activicies among the varioas prime con- <br />tractocs wi[t be identified in the Supplementary Conditions. <br />and the spccific natters to be covered by such authority ac►d <br />8 responsibitity witl be itemized, and the extent of such authoc- <br />ity and responsibilities will be provided, in the Supplementary <br />Conditions. Unlcss othervise pcovided in the Supplementary <br />Conditions, neither OWNER nor ENG[NEER shall have any <br />authority or responsibifity in respect of such coordination. <br />ARTICLE 8-OWNER'S RESPONSIBILITIES <br />8.1. OWNER shall issue all commanications to CON- <br />TRACT'OR through ENGINEER. <br />8.2. In ease of tccmination of the employmcnt of ENGI- <br />NEER. OWNER shall appoint an enginecr against whom <br />COM'RAC'COR makes no reasonable objection, whose sta- <br />tus undec the Contract Documents shall be that oCthe former <br />ENGINEER. Any dispute in eonnection with sach appoint- <br />ment shall be subject to arbitration. <br />8.3. OWNER shaU furnish the data cequired of OWNER <br />under the Contcact Documents prompt(y and shall make pay- <br />ments to CONTRACTOR pcomptIy aftec they are due as <br />providcd in pacagraphs 14.4 and 14.13. <br />8.4. OWNER is obl;gated to cxccutc Cliangc Ordccs as <br />indicatcd in paragraph 10.4. <br />8.7. OWNER's responsibility in respcct of ccrtain <br />inspcctions, tests and approvals is sct Cortli in paragcaph 13.4. <br />8.5. Pacagraph 15.2 <br />deals with OWNER's right to terminate services of CON- <br />TRACTOR under certain circumsiances. <br />ART'ICLE 9-bNGINEER'S ST'ATUS DURING <br />CONSTRUCTION <br />Owner's Represenlalive: <br />9.1. ENGINEER will be OWNER's representative dur- <br />ing the construction pcriod. Tha duties and responsibilities <br />and the [imitations ofauthority of ENGINEERas OWNER's <br />representative during construction are set forth in the Con- <br />tract Documents and shall not be extended without written <br />consent of OWNER and ENGINEER. <br />Visits 1o Site: <br />9.2. ENGINEER will make visits to the site at intcr.vals <br />appropriate to the various stages of construction to observe <br />the progress and quaIity of the executed Work and td-deter- <br />mine, in genecat, if the Work is proceeding in accordance <br />.with the Contract Documents. ENGIN EER wil( not be required <br />to make exhaustive or eontinuous on-site inspections to check <br />the quality oc quantity of the Work. ENGINEER's efforts <br />will be dicected toward providing for O WN ER a greater degmc <br />of confidence that the compteted Wor[c will confocm to the <br />Coatract Documents. On the basis of such visits and on-site <br />observations as an experienced and qualified design profes- <br />sional, ENGINEER wit[ keep OWNER infocmed oCthe prog- <br />ccss of the Work and wiil endeavor to guard OWNER against <br />defects and deficicncies in the Work. : <br />Project Represeacetion: <br />* 9.3. If OWNER and ENGINEER agree, ENGINEER <br />wili furnish a Resident Project Representative to assist <br />ENGINEER in obsecving the pecCocmance oCthe Work. The <br />duties, responsibilities and limitations of authority of any <br />such Resident Projcct Rcpresentative and assistants will be <br />as pcovidcd in the Supplcmentary Conditions.
