BETWEEN THE FO:LIAWING LIMITS Y TO -WIT : FROM AS 14o wt4 oN A7t'AC+w-.a 'PC.hU a) FIEREINAFTER REFERRED TO AS "THE PROJECT" AND AUTHORIZING THE MAYOR OF THE CIT7C TO EXECUTE AND TI-iE CITY SECRETARY TO AFFIX THE CORPORATE SEAL AND ATTEST THE SAME, A CERTAIN CONTRACT BETWEEN THE CITY AND THF STATE OF TEXAS PRQVIDING FOR THE CONSTRUC- TION, MAINTENANCE, EXISTENCE AND USE OF SAID PROJECT; AND DETERMINING THE LIABILITIES AND RESPONSI$ILITIES OF THE CITY 11ND THE STATE OF TEXAS WITH MERENCE THERETO; AND DECIAftING AN EMERGENCY AND PROVIDINC, TFiAT TFIE ORDINANCF SFiALL BE EFFECTI1lE FROM AND AF'TER ITS PASSAGE. WHEREAS, the public convenience, sefety and necessity of the City, and the ~#ar- from people of the City require that the portion of F. M gighway No. L- 2.-~ & QS S"uJf.L 9l,L /4Tr4t,14r-_r% PL14Y.1 S t;g,- be constructed, since the existing condition the public, which it is urgently required to constitutes a serious inconvenience to be remedied; and WHEREAS, the City has requested the State of Texas to contribute financielly in the pro,ject; and WHEREAS, the State of Texas has made it known to the City that the State will assist the City in the improvement and maintenance of said project, providing the City approves the plans fpr said project. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL: SECTION l. That since the public-convenience, safety and necessity of the City and the people of the City require it, said project shall be constructed. SECTION 2. That the Mayor of the City be and is hereby authorized to execute for anc] on behalf of the City an a,reement and contract with the Stete of Texas in ac- cordance with and for the purpose of carrying out the terma and proviaions of this ordinance, in the form attached hereto and ma.rked "Exhibit B". The Mayor ofl the City ie further author3zed to approve and sign the deteiled plans for constructian oP the project or eny section thereof when anc3 as such plans are completed and prior to award ofl construction contract by the State. The City Secretary is hereby directed to attest the agreement and contract and to affix the proper seal of the City thereto. SECTION 3. That the State of Texas be and is hereby authorized to enter upon and construct the pro,ject at .the location and in the manner shown on the plena to be approved by the Mayor and atteched hereto, marked "Exhibit A", and made a part hereoP in all respects, and to maintain such project all as is provided in the agreememt hereto attached. 1 Form 1068
