ORDINANCE NO. 1818 . <br />AN ORDINANCE TO REGULATE THE PRODUGTIO1Vg TRANSPORTATION, <br />PROCESSINGp HANDLING, SAMPLING, EXAMINATION, GRADING, LABEL- <br />ING, AND SALE OF MILK AND MILK PRODUCTS, THE INSPECTION OF <br />DAIRY HERDS, DAIRY FARM5, AND MILK PLANTS,, THE ISSUING AND RE- <br />VOCATION OF PERMITS TO MILK PRODUCER5, HAULERS, AND DISTRIBU- <br />TORS; REPEALING ALL ORDINANCES IN CONFLICT; AND ADOPTION BY <br />REFERENCE OF THE 1965 PUBLIC HEALTH SERVICE MILK ORDINANCE <br />AND CODE HERETOFORE ADOPTED BY THE STATE OF TEXAS; FIXING AN <br />EFFECTIVE DATE; AND PROVIDING A PENALTY OF NOT TO EXCEED <br />$200.00 FOR EACH VIOLATION. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br />SECTION 1, The production9 transportation, processing, handling, sampl- <br />ings examination, grading, labeling, and sale of milk and milk products sold for <br />the ultimate consumption within the City of Paris or its police jurisdiction; the <br />inspection of dairy herds, dairy farms, and milk plants; the issuing and revoca- <br />tion of permits to milk producers, haulers, and distributors shall be regulated <br />in accordance with the provisions of the Texas Milk Grading and Labeling Law <br />and the Texas Specifications and Requirements, thereunder authorized, and the <br />applicable provisions of 1965 Public Health Service Milk Ordinance and Code, <br />certified copies of which shall be filed in the office of the appropriate official: <br />Provided, That Section 9 of said Texas Specifications and Requirements shall <br />replaced by Section Z below. <br />SEGTION 2. From and after 12 months from the date on which this <br />Ordinance is adopted, only Grade A milk and milk products shal}, be sold to the <br />fina consumer, or to restaurants, soda fountains, grocery stores, or similar <br />establishments: Provided, That in an emergency the sale of pasteurized milk <br />and milk products which have not been graded, or the grade of which is unknown, <br />may be authorized by the health authority; in which case, such milk and milk pro- <br />ducts shal], be labeled "ungraded. " <br />SECTION 3. Any person who shall violate any of the provisions of this <br />Ordinance shall be guilty of a misdemeanor ands upon conviction thereof, shall <br />be punished by a fine of not more than $200. 00' and/or such persons may be <br />enjoined from continuing such violations. Each day upon which such a violation <br />occurs shalX constitute a separate violation. <br />SECTION 4. A11 ordinances and parts of ordinances in conflict, with this <br />Ordinance, shall be repealed 12 months after the adoption of this Ordinance, at <br />which time this Ordinance shall be in full force and effect, as provided by law. <br />Passed and adopted this 13th day of February, A.
