ORDINANCE NO, 1868 , <br />AN ORDINANCE PROVIDING DEFINITIONS; DECLARING THE PRE- <br />SENCE OF ANY JUNKED MOTOR VEHICLE WITHIN THE CITY OF PARIS <br />SHALL BE DEEMED A PUBLIC NUISANCE, WITH CERTAIN EXCEPTIQNS; <br />PROVIDING FOR NOTICE TO THE OWNER OR.OCCUPANT.TO ABATE PUB- <br />LIC NUTSANCE ON OCCUPIED PREMISES; PROVIDING FOR NOTICE TO <br />OWNER TO ABATE PUBLIC NUISANCE ON UNOCCUPIED PREMISES; PRO«• <br />VIDING FOR PRELIMINARIES TO TRIAL IN CORPORATION COURT; FRO•• <br />VIDING FOR TRIAL IN CORPORATION COURT; PROVIDING FOR REMOVAL <br />TnTITH PERMISSION OF OWNER OR OCCUPANT; PROVIDING FOR REMOVAL <br />FROM UNOCCUFIED PREMISES BY ORDER OF CORPORA.TION COURT; PRO- <br />VIDING F0R RULE OF EVIDENCE OF ABANDONMENT; PROVIDING FOR A <br />FINE NOT TO EXCEED $200.00; PROVIDING FOR A CUMULATIVE PRO- <br />VISION; PROVIDING FOR A SAVINGS CLAUSE; AND PROVIDING FOR AN <br />EFFECTIVE DATE OF JUNE 24, 1968, <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 'PPRIS: <br />ARTICLE I TITLE <br />The title of this Ordinance shall be "Junked Motor Vehicle <br />Regulations," and it may be cited as such, <br />ARTICLE II ••-DEFINITIONS <br />For the purposes of this Ordinance, the following terms, <br />phrases, words and their derivations shall have the meaning given <br />herein, When not inconsistent with the context, words used in <br />the present tense shall include the future; words used in the <br />plural number include the singular number; and words used in the <br />singular number include the plural number. The word "shall" is <br />always mandatory and not merely directory; <br />(a) Junked Motor Vehicle - Any motor vehicle, as <br />defined in Section 2 b, Article II of the Traffic <br />Code of the City of Paris, Ordinance No. 1406, which <br />does not have lawfully affixed thereto both an un•. <br />expired license plate or plates and a valid motor <br />vehicle saf ety inspection certificate, and the con- <br />dition of which is one or more of the followingo <br />1. Wrecked <br />2, Dismantled <br />3. Partially dismaxitled <br />4. Inoperative <br />5, Abandoned <br />6, Discarded <br />Exceptions: The provisions hereto shall not apply to: <br />A. Any motor vehicle in operable condition specifically <br />adapted or constructed for racing or operation on <br />privately owned drag strips or raceways; <br />B. Any motor vehicle retained by the owner for antique <br />collection purposes rather than fo r salvage or for <br />transportation; nor <br />C. Any motor vehicle stored as the property of a member <br />of the Armed Forces of the United States who is on <br />active duty assignment. <br />(b) Person Any individual, firm, partnership, assoca.a- <br />tion, corporation, company or o rganization of any kind, <br />ARTICLE III JUNKED MOTOR VEHICLES <br />DECLARED A PUBLIC NUISANCE <br />The presence of any junked motor vehicle on any private lot, <br />tract or parcel of land, or portion thereof, occupied or unoccupied, <br />
