ARTICLE 17__MISCELLANEOUS <br /> <br />Giving Notice: <br /> 17.1. Whenever any provision of the Contract Docu- <br />ments requires thc giving of written notice, it will be doomed <br />to have been vulldly given if delivered in person to the indi- <br />vidual or to a member of the firm or to an officer of the <br />corporation for whom it is intended, or if dellvered at or sent <br />by registered or certified mail, postage prepaid, to the last <br />business address known to the giver of the notice. <br /> <br />Computation of Time: <br /> 17.2.1. When any period of time is referred to in the <br /> Contract Documents by days, it will be computed to exclude <br /> the first and include the last day of such period. If the last <br /> day of any such period fails on a Saturday or Sunday or <br /> on a day inadc a legal holiday by. the law of the applicable <br /> jurisdiction, such day will be omitted from the computa- <br /> tion. <br /> 17.2.2. A calendarday oftwenty-fourhours measured <br /> from midnight to the next midnight shall constitute a day: <br /> <br />17.3. Should OWNER or CONTRACTOR suffer iRiury <br /> <br />sion or act of the other party or of any of the other party's <br />employees or ag~:nrs or others for whose acts the other Party <br />is legally liable, clai.m will he made in writing to the other <br />party within a reasonable time of the first observance of such <br />injury or damage. The provisions of this paragraph 17.3 shall <br />not be construed as a substitute for or a waiver or tho pro- <br />visions of any aplSlieable statute of limitations or repose. <br /> <br /> 17.4. Thc duties and obligations imposed by these Gcn~ <br />oral Conditions and the rights and remedies available here- <br />under to the parties hereto, and, in particular but without <br />limitation, the warranties, guarantees and obligations imposed <br />upon CONTRACTOR by paragraphs 6.30- 13.1.13.12.13.14. <br />14.3 and 1.~.2 and all of the fights and remedies available to <br />OWNER and ENGINEER thereunder, are in addition to, <br />and are not to be construed in any way as a limitation of, an~' <br />fights and remedies available to any or all of the m which are <br />otherwise imposed or available by Laws or Regulations, by <br />special warranty or guarantee or by other provisions of the <br />Contract Documents, and the provisions of this paragraph <br />will be as ~ffective as if repeated specifically in the Contract <br />Documents in connection with each particular' duty, obliga- <br />tion, right and remedy to which they apply. All representa- <br />tions, warranties and guarantees made in the Contract Doc- <br />uments will survive final payment and termination or com- <br />pletion of the Agreement. <br /> <br /> <br />
